Circular 06/2024/TT-TTCP stipulating the electronic storage of inspection files, complaint resolution files, denunciation resolution files?
On July 1, 2024, the Chief Government Inspector of Vietnam issued Circular 06/2024/TT-TTCP stipulating the establishment and management of inspection files, complaint resolution files, denunciation resolution files.
The subjects of application of Circular 06/2024/TT-TTCP include:
(1) Heads of state management agencies, heads of inspection agencies, heads of agencies assigned to perform specialized inspection functions, heads of inspection teams, members of inspection teams, and persons assigned to perform specialized inspection tasks.
(2) Persons authorized to resolve complaints and denunciations; persons assigned to verify the content of complaints and denunciations.
(3) Agency archives performing the storage of inspection files, complaint resolution files, denunciation resolution files.
According to Article 4 of Circular 06/2024/TT-TTCP, the regulations on electronic storage of inspection files, complaint resolution files, denunciation resolution files are as follows:
- In cases where documents to be stored in inspection files, complaint resolution files, and denunciation resolution files do not have a paper copy as prescribed and only have an electronic version, the inspection decision-maker, the complaint resolver, the denunciation resolver, and related agencies, organizations, and individuals shall collect and manage electronic documents and files according to the provisions of the 2011 Archives Law and other relevant legal regulations.

How to establish an inspection file according to the order?
According to Article 6 of Circular 06/2024/TT-TTCP, the process of establishing an inspection file is as follows:
- Opening the file
+ The file is opened from the date the authorized person signs the inspection decision;
+ Based on the approved inspection plan, the person assigned to establish the file opens it and updates the initial information about the file.
- Collecting and updating documents into the file
+ The person assigned to establish the file is responsible for collecting and updating documents during the inspection process into the opened file, ensuring the accuracy, integrity, systematization, and completeness of the file;
+ Documents in the file must be arranged according to the groups specified in Article 7 of Circular 06/2024/TT-TTCP.
- Concluding the file
+ The file is concluded on the date the authorized person issues the document to organize the implementation of the inspection conclusion;
+ The person assigned to establish the file is responsible for reviewing all documents in the file, removing duplicate and draft documents, correcting titles, number, and symbols of the file as appropriate, completing, and concluding the file.
Main documents and documents issued by the Inspection Team in the inspection file include which documents?
According to Clauses 1 and 2, Article 7 of Circular 06/2024/TT-TTCP, the inspection file includes:
(1) Group 1 on main documents, including:
- Directives and requests from agencies or authorized persons as a basis for issuing inspection decisions (if any);
- Reports on the results of information collection to prepare for the inspection (if any);
- Inspection decision; documents to suspend, supplement, change the head and members of the inspection team (if any);
- Inspection plan; plans to amend and supplement the inspection plan content (if any);
- Inspection result report;
- Documents concluding, directing the handling, and deciding handling by the inspection decision-maker or authorized level; documents executing the inspection decision-maker's rights;
- Decisions to extend the inspection period, suspend, continue, or terminate the inspection (if any);
- Inspection conclusion;
- Documents recommending prosecution and transferring related case files and documents to investigation agencies; documents notifying the outcome of the case resolution from investigation agencies (if any);
- Documents publicizing the inspection conclusion;
- Documents organizing the implementation of the inspection conclusion.
(2) Group 2 on documents issued by the Inspection Team during the inspection process, including:
- Documents and outlines requesting the inspected object report on the inspected content;
- Minutes announcing the inspection decision;
- Minutes prepared by the head and members of the inspection team when working with the inspected object and related agencies, organizations, and individuals;
- Progress reports and situation reports on the inspection mission to the inspection decision-maker;
- Documents and decisions exercising the rights of the head and members of the inspection team (if any);
- Documents and reports verifying the inspection content by the inspection team or its members;
- Documents and reports by the inspection decision-maker, documents notifying the inspected object about the conclusion of the direct inspection;
- Documents assigning tasks of the head of the inspection team to the inspection team members; task completion reports by the inspection team members;
- Minutes of the inspection team's meeting on the draft inspection result report;
- Minutes working with the inspected object on the explanation at the meeting regarding the draft inspection conclusion content (if any);
- Minutes of the meetings and work sessions of the inspection decision-maker, the head of the presiding agency or unit of the inspection with the inspection team, and notices on the concluding opinions of the presiding person (if any);
- Documents preserving the opinions of the head and members of the inspection team (if any) on the draft inspection result report and draft inspection conclusion;
- Inspection team log;
- Minutes summarizing the inspection team's activities.
Note: Circular 06/2024/TT-TTCP takes effect from August 15, 2024.
