According to Official Letter 2380/TCHQ-GSQL in 2022, implementing Decree 102/2020/ND-CP issued by the General Department of Customs as follows:
Based on the survey results on the implementation of Decree No. 102/2020/ND-CP dated September 1, 2020 of the Government regulating the legal timber guarantee system, the General Department of Customs proposed the Customs Department The provinces and cities shall guide their attached units to uniformly implement the following contents:
- Regarding the certification of the Customs officer on the List of imported timber (Form No. 01) and the List of imported wood products (Form No. 02)
+ Requesting units to inspect and certify the list of imported timber for imported wood shipments as prescribed at Point b, Clause 3, Article 27 of Decree No. 102/2020/ND-CP and instructions at Point b, Clause 3, Article 27 of Decree No. Official Dispatch No. 7131/TCHQ-GSQL dated November 6, 2020 of the General Department of Customs. Problems encountered in the implementation process, the General Department of Customs recognizes and will comment when amending and supplementing Decree No. 102/2020/ND-CP.
- Regarding the declaration of imported timber origin (Form 03) issued together with Decree No. 102/2020/ND-CP
+ According to the provisions of Decree No. 102/2020/ND-CP, the owner of imported timber is the person who signs, writes his/her full name and stamps (if any) on Form No. 03 issued together with Decree No. 102/2020/ ND-CP. Accordingly, it is requested that the units guide enterprises in Vietnam to strictly comply with the regulations on the Declaration of Imported Wood Origin (Form 03) and only accept the Declaration of Imported Wood Origin signed by the imported timber owner. , stamp (if any).

How are imported timber records regulated?
According to Article 7 of Decree 102/2020/ND-CP stipulating the legal timber assurance system in Vietnam, regulations on imported timber documents are as follows:
When carrying out customs procedures for imported timber shipments, in addition to the set of customs dossiers prescribed by law on Customs, the owner of imported timber must submit to the customs office where the declaration is registered the following documents: :
- The original list of imported timber made by the timber owner according to Form No. 01 or Form No. 02, Appendix I promulgated together with this Decree.
- One of the following documents:
+ In case of timber included in the CITES Appendix: A copy of the CITES permit for export or re-export issued by the CITES management authority of the exporting country or the country of re-export; A copy of the CITES import license issued by the CITES management authority of Vietnam;
+ In case timber is imported from a country that has signed a Legal Timber Agreement with the EU and is operating the FLEGT licensing system: A copy of the FLEGT export license issued by the competent authority of the exporting country;
+ In case the imported wood shipment is not specified at Point a or Point b of this Clause: A declaration of the origin of imported timber, made according to Form No. 03, Appendix I issued together with this Decree.
