Guidelines for Compiling Statistical Reports on Civil Judgment Enforcement and Monitoring Administrative Judgment Enforcement, Effective from July 26, 2024?

Article 8 of Circular 05/2024/TT-BTP stipulates the preparation of statistical reports as follows:

- At the end of the statistical reporting period, the agencies and individuals specified in Clause 1, Article 3 of Circular 05/2024/TT-BTP must finalize and close the data to prepare the statistical report form. The results of each period must be reported within that period. It is strictly forbidden to transfer statistical data generated in the current period to the next period.

- At the end of the quarterly, semi-annual, ten-month, and annual reporting periods, the Civil Judgment Enforcement Branch finalizes the data, prepares a list of unenforceable civil judgments that have been separately tracked; a list of civil judgments being enforced; a list of state compensation cases being monitored and resolved (including cases under the jurisdiction of the People's Court); and a list of judgments for credit institutions sent to the Civil Judgment Enforcement Division.

The Civil Judgment Enforcement Division finalizes the data, prepares a list of unenforceable civil judgments that have been separately tracked; a list of civil judgments being enforced; a list of state compensation cases being monitored and resolved (including cases under the jurisdiction of the People's Court); and a list of judgments for credit institutions at the Civil Judgment Enforcement Division and compiles a comprehensive list for the entire province to be sent to the General Department of Civil Judgment Enforcement for monitoring and management.

The District Military Judgment Enforcement Office finalizes the data, prepares a list of unenforceable civil judgments, a list of state compensation cases being monitored and resolved, and sends them to the Civil Judgment Enforcement Department of the Ministry of National Defense for monitoring and management.

- At the end of the annual reporting period, the Civil Judgment Enforcement Branch finalizes the data, prepares a list of unenforceable civil judgments to be carried forward to the next period and sends it to the Civil Judgment Enforcement Division. The Civil Judgment Enforcement Division finalizes the data, prepares a list of unenforceable civil judgments to be carried forward to the next period at the Civil Judgment Enforcement Division, and compiles a comprehensive list for the entire province to be sent to the General Department of Civil Judgment Enforcement for monitoring and management.

Article 9 of Circular 05/2024/TT-BTP stipulates the format and method of sending statistical reports as follows:

(1) Statistical reports on civil judgment enforcement are presented in the form of paper documents or electronic documents:

- Paper reports must be signed, with the full name of the person preparing the report; signed, with the full name of the head of the unit and stamped according to regulations. The statistical report of the executor must be signed by the executor and confirmed by the head of the unit;

- Electronic reports are presented in the form of images (pdf format) of paper reports or electronic documents in electronic file format authenticated by the digital signature of the head of the civil judgment enforcement agency according to regulations.

(2) Statistical reports on civil judgment enforcement are sent to the recipient by the following methods:

- Sent via official email provided by the Ministry of Justice (*@moj.gov.vn)

- Sent on the Document Management Software of the Ministry of Justice (qlvb.moj.gov.vn)

- The sending of statistical reports on civil judgment enforcement in the military is carried out according to the regulations of the Ministry of National Defense and the guidance of the Civil Judgment Enforcement Department of the Ministry of National Defense.

What are the deadlines for sending statistical reports from July 26, 2024?

Article 10 of Circular 05/2024/TT-BTP stipulates the procedure and deadlines for sending statistical reports as follows:

- Within 01 working day from the end of the statistical reporting period, the executor must prepare and send the statistical report to the head of the unit where they work.

- Within 02 working days from the end of the statistical reporting period, the Civil Judgment Enforcement Branch must compile, prepare and send the statistical report to the Civil Judgment Enforcement Division, which is the direct superior, and other relevant agencies receiving statistical reports.

- Within 04 working days from the end of the statistical reporting period, the Civil Judgment Enforcement Division must compile, prepare and send the provincial statistical report to the General Department of Civil Judgment Enforcement and other relevant agencies receiving statistical reports.

- Within 01 working day from the end of the statistical reporting period, the military executor must prepare and send the statistical report to the Head of the Military Judgment Enforcement Office where they work.

- Within 02 working days from the end of the statistical reporting period, the Military Judgment Enforcement Office must prepare and send the statistical report to the Regional Commander, the Civil Judgment Enforcement Department of the Ministry of National Defense, and other relevant agencies receiving statistical reports.

- Within 04 working days from the end of the statistical reporting period, the Civil Judgment Enforcement Department of the Ministry of National Defense must compile, prepare, and send the statistical report to the Minister of National Defense, the Minister of Justice, and other relevant agencies receiving statistical reports.

- Within 06 working days from the end of the statistical reporting period, the General Department of Civil Judgment Enforcement compiles national statistical data on civil judgment enforcement and monitoring administrative judgment enforcement, including military civil judgment enforcement data, and reports to the Minister of Justice to report to the Prime Minister, the Government of Vietnam, the National Assembly, and other competent agencies upon request.

Circular 05/2024/TT-BTP takes effect from July 26, 2024.
