Registration Dossier for Fixed Passenger Transport on the Waterway Route from Shore to Island Effective from December 15, 2022: Regulations and Requirements.
From December 15, 2022, how is the responsibility for managing the waterway transport route from shore to island regulated?
According to Clause 1, Clause 2 Article 1 Circular 24/2022/TT-BGTVT which stipulates the procedures for registering fixed passenger transport on the waterway route from shore to island as follows:
Responsibility for managing waterway transport route from shore to island
1. The Vietnam Maritime Administration organizes the management of waterway transport activities on the routes stipulated in Annex I issued together with this Circular in accordance with maritime and inland waterway transport laws; organizes the inspection and guidance for the implementation and compliance with the legal provisions of maritime and inland waterway transport laws for the waterway transport routes from shore to island in Annex I issued together with this Circular, which have been decentralized by the Ministry of Transport to the People’s Committees of provinces and centrally-run cities.
2. The Vietnam Inland Waterways Administration organizes the management or inspects and guides the agencies and units assigned to organize the management of other waterway transport routes from shore to island announced according to the provisions of inland waterway transport laws; organizes the inspection and guides the implementation and compliance with the legal provisions of inland waterway transport for the waterway transport routes from shore to island, which have been decentralized by the Ministry of Transport to the People’s Committees of provinces and centrally-run cities.
3. Based on the proposals of the People’s Committees of provinces and centrally-run cities, the Ministry of Transport will consider and decentralize the organization of waterway transport activities on the proposed routes according to current regulations.
Thus, from December 15, 2022, the responsibility for managing the waterway transport routes from shore to island is regulated as above.

According to Clause 1 Article 3 Circular 16/2013/TT-BGTVT (amended by Clause 1 Article 1 Circular 08/2022/TT-BGTVT) which stipulates the procedures for registering fixed passenger transport on the waterway route from shore to island as follows:

The procedures for registering fixed passenger transport on the waterway route from shore to island as stipulated in Annex I attached to this Circular are as follows:
1. Organizations and individuals send directly or via the postal system to the regional maritime administration, the agency, unit assigned by the People’s Committee of provinces and centrally-run cities (in case of decentralization), or send online via the online public service system the fixed passenger transport registration dossier, the dossier includes:
a) The passenger transport operation registration form as stipulated in Annex II issued together with this Circular;
b) The written agreement or contract with the port management organization for the vehicle to pick up and drop off passengers;
c) Certified copies with the originals for comparison or legally valid electronic copies issued by a competent authority, including: Business registration certificate or Enterprise registration certificate or Investment certificate, which includes the passenger transport business sector; Vehicle registration certificate; Certificate of technical safety and environmental protection of the vehicle valid and suitable for the operational route.
Thus, the passenger transport registration dossier on the waterway route from shore to island before December 15, 2022, is regulated as above.

Based on Clause 3 Article 1 Circular 24/2022/TT-BGTVT which stipulates the procedures for registering fixed passenger transport on the waterway route from shore to island as follows:
Amend and supplement some articles of Circular No. 16/2013/TT-BGTVT dated July 30, 2013, by the Minister of Transport regulating the management of the waterway transport routes from shore to island within the territorial waters of Vietnam

The procedures for registering fixed passenger transport on the waterway route from shore to island as stipulated in Annex I attached to this Circular are as follows:
1. Organizations and individuals send directly or via the postal system to the regional maritime administration the fixed passenger transport registration dossier, the dossier includes:
a) The passenger transport operation registration form as stipulated in Annex II attached to this Circular.
b) The written agreement or contract with the port management organization for the vehicle to pick up and drop off passengers.
c) Certified copies (or copies with originals for comparison), including:
- Business registration certificate or Enterprise registration certificate or Investment certificate, which includes the passenger transport business sector;
- Vehicle registration certificate;
- Certificate of technical safety and environmental protection of the vehicle valid and suitable for the operational route.
