New Standards for the Titles of Head and Deputy Head of District-Level Departments Starting from May 01, 2024

On March 6, 2024, the Government of Vietnam issued Decree 29/2024/ND-CP stipulating general standards applicable to leadership and management official titles in state administrative agencies.

*The new standards for the title of Head of District-Level Department starting from May 01, 2024 (stipulated in Article 31https://thuvienphapluat.vn/van-ban/Bo-may-hanh-chinh/Nghi-dinh-29-2024-ND-CP-tieu-chuan-chuc-danh-lanh-dao-quan-ly-trong-co-quan-hanh-chinh-nha-nuoc-326382.aspx?anchor=dieu_31Decree 29/2024/ND-CP) are as follows:

- The Head of a District-Level Department and equivalent positions are the heads of the Department, responsible for managing and organizing the implementation of state management functions and tasks in specific sectors or areas within the district and other tasks assigned by competent authorities; directly accountable to the District People's Committee, the Chairman of the District People's Committee, and the law for the assigned responsibilities and tasks.

- Meet 5 general standards as specified in Section 1, Chapter II of Decree 29/2024/ND-CP, including:

+ Standards on political ideology

+ Standards on ethics, lifestyle, disciplinary organizational awareness; standards on qualifications

+ Standards on competence and reputation

+ Standards on health, age, and work experience

In addition to the above standards, the following specific standards must also be met:

+ Mastery of professional and technical expertise; implement state policies and laws in the relevant sector or assigned tasks under the direction of the District People's Committee and specialized agencies of the Provincial People's Committee; advise on implementing inspection, examination, and legal handling within the locality; propose or directly resolve complaints and petitions from organizations and citizens under their jurisdiction.

+ Holding the position of Deputy Head and equivalent positions at the district level or equivalent positions as regulated by competent authorities according to the cadre management hierarchy. If not holding the position, there must be continuous work experience in the sector or field for at least 04 years (excluding probationary and trial periods).

*The new standards for the title of Deputy Head of District-Level Department starting from May 01, 2024 (stipulated in Article 32 of Decree 29/2024/ND-CP) are as follows:

The Deputy Head and equivalent positions at the district level assist the Head in carrying out assigned responsibilities and are accountable to the Head and the law.

- Meet 5 general standards

+ The Deputy Head of the Department and equivalent positions at the district level must meet the following 5 general standards: Standards on political ideology; standards on ethics, lifestyle, and disciplinary organizational awareness; standards on qualifications; standards on competence and reputation; standards on health, age, and work experience (as mentioned above for the Head of the Department).

- In addition, the Deputy Head and equivalent positions at the district level must meet the following specific standards:

+ Mastery of professional and technical expertise; implement state policies and laws in the relevant sector or assigned tasks under the direction of the District People's Committee and specialized agencies of the Provincial People's Committee; advise, implement inspections, examinations, and legal handling within the locality; compile and propose resolutions for complaints and petitions from organizations and citizens under their jurisdiction.

+ A minimum of 02 years of continuous work experience in the sector or field (excluding probationary and trial periods).

What are the qualification standards that the Head and Deputy Head of District-Level Departments must meet?

According to Article 6 of Decree 29/2024/ND-CP, the qualification standards for the Head and Deputy Head of District-Level Departments are as follows:

- Must hold a university degree or higher relevant to the sector or field of work as regulated by competent authorities.

- Regarding political theory:

Must have a diploma of intermediate political theory or higher or a certificate equivalent to intermediate political theory level issued by a competent authority.

- Regarding state management:

Must have a certificate of training in state management knowledge and skills for civil servants at the equivalent rank of specialist or higher.

- Must possess foreign language proficiency appropriate for the leadership, management position as regulated by relevant ministries, central authorities, and local authorities or be able to use a minority language in cases where the position directly involves minority communities or the position involves tasks in minority areas. Determining foreign language proficiency and equivalent qualifications and certifications shall be in accordance with the law.

What are the political ideology standards for the titles of Head and Deputy Head of District-Level Departments?

According to Article 4 of Decree 29/2024/ND-CP, the political ideology standards for the titles of Head and Deputy Head of District-Level Departments are as follows:

- Loyalty to the interests of the Communist Party, the nation, the people; steadfast in Marxism-Leninism, Ho Chi Minh thought, and the goals and ideals of national independence, socialism, and the reforms of the Communist Party.

- Firm political stance and perspective, resolute in defending the Program, the line of the Communist Party, the Constitution, and the law.

- Patriotic spirit, placing the interests of the Communist Party, the nation, the people, and the collective above personal interests.

- Compliance with the assignments of agencies and organizations; adherence to the discipline of statements according to the principles and regulations of the Communist Party and the law.

Decree 29/2024/ND-CP takes effect from May 01, 2024.
