From July 01, 2024, policies for participants in the security and order protection forces at the grassroots level?

In the afternoon of November 28, 2023, at the 6th session, the National Assembly passed the Law on Forces Participating in Security and Order Protection at the Grassroots Level 2023.

Immediately after, National Assembly Chairman Vuong Dinh Hue signed and promulgated Resolution 110/2023/QH15 approving 7 Laws, including the Law on Forces Participating in Security and Order Protection at the Grassroots Level 2023.

Article 24 of the Law on Forces Participating in Security and Order Protection at the Grassroots Level 2023 stipulates policies for participants in security and order protection forces at the grassroots level from July 01, 2024:

- Those who have participated in social insurance, health insurance, and are eligible for benefits will have policies paid from the insurance fund as per legal regulations.

- Those who have not participated in health insurance and suffer from illness, injury, or an accident will receive support to cover medical examination and treatment costs.

- Those who have not participated in social insurance and sustain an accident causing labor ability reduction as concluded by the Medical Examination Council will be considered for allowance based on the reduction level; if deceased, their relatives will receive a survival allowance and burial expenses.

- Those injured or killed while performing their duties will be considered for policies similar to war invalids or recognized as martyrs and enjoy other rights as stipulated by law.

- The Government of Vietnam will detail Clause 2 and Clause 3, Article 24 of the Law on Forces Participating in Security and Order Protection at the Grassroots Level 2023.

What are the duties of the forces participating in security and order protection at the grassroots level?

Chapter II of the Law on Forces Participating in Security and Order Protection at the Grassroots Level 2023 stipulates the duties of these forces, including:

- Assisting in assessing security and order situations

- Supporting the development of the all-people movement to protect the national security

- Assisting in fire prevention and firefighting, rescue, and relief operations

- Assisting in administrative management regarding social order

- Supporting the mobilization and education of individuals with law violations residing in the community

- Performing patrols to ensure security, order, traffic safety, and carrying out security and order protection tasks when mobilized

What are the standards for participating in the forces protecting security and order at the grassroots level?

Article 13 of the Law on Forces Participating in Security and Order Protection at the Grassroots Level 2023 outlines the standards for participants as follows:

- Vietnamese citizens aged 18 to 70; those over 70 can participate if they meet health requirements upon approval by the Chairman of the Commune People's Committee based on the proposal of the commune police.

- Clear background, good ethical qualities, compliance with the policies of the Communist Party, state laws, and no ongoing criminal responsibility, serving criminal sentences in the community, judicial measures, or administrative measures enforcement. Individuals with cleared criminal records or completed enforcement of judicial/administrative measures should meet legal timelines for being considered non-recipient.

- Having a diploma or certificate of completion of general education. In border, island areas, mountainous, economically challenged regions, and ethnic minority areas, those who have completed secondary education can be recruited; if insufficient, those completing primary education can be considered.

- Permanent or temporary residence for one year or more and frequent living at the location where the application for participation is submitted. If as per Clause 3, Article 15, the Law on Forces Participating in Security and Order Protection at the Grassroots Level 2023, residence should be permanent or temporary where the application is submitted.

- Sufficient health as certified by medical facilities established and operating under legal regulations.

*Note: The Law on Forces Participating in Security and Order Protection at the Grassroots Level 2023 takes effect from July 01, 2024.
