What is the plant protection chemical in Vietnam? What are the regulations on using plant protection chemicals?

Pursuant to Clause 16, Article 3 of the Law on Plant Protection and Quarantine 2013, plant protection chemical is defined as follows:

Plant protection chemical means the substance or any mixture of substances or the microbiological agent which is meant for preventing, inhibiting, repelling, seducing, destroying or mitigating the harmful impact of plant pests, pathogens and diseases; regulating or controlling the growth of plants or insects; serving the purpose of plant storage; increasing the safety and efficacy for the use of various plant protection products.

According to Clause 3, Article 4 of the Law on Plant Protection and Quarantine 2013, the use of plant protection chemicals must comply with 4-right rules as follows:

- Right product;

- Right time;

- Right dose and concentration;

- Right method.

Users of plant protection chemicals must adhere to regulated quarantine duration, ensure the efficacy of plant protection chemicals and safety for people, food safety and mitigate environmental pollution and ecological protection.

What are the quality standards for plant protection chemicals in Vietnam?

Based on Section 2 of the National Technical Regulation QCVN 01-188:2018/BNNPTNT on the quality of plant protection chemicals issued together with Circular 12/2018/TT-BNNPTNT, the quality of plant protection chemicals is determined based on the following factors:

- Requirements for active ingredient content

- Indicators of physico-chemical properties include:

+ Technical requirements for physico-chemical indicators: Fineness, Dry sieve test fineness, Wet sieve test fineness, Foamability, Wetness, Particle size, Dustiness, Dispersion and self-dispersion, Hover rate, Dispersion strength, Emulsion strength, Solubility and solution strength, Dilution Strength, Storage Strength at 0°C, High Temperature Storage Strength, Bonding;

+ Requirements for toxic impurities.

- Technical requirements for forms of plant protection chemicals, including: Technical requirements for chemical-pesticides and Technical requirements for bio-pesticides.

In what case are plant protection chemicals not eligible for the List of permitted plant protection chemicals in Vietnam?

Clause 1, Article 49 of the Law on Plant Protection and Quarantine 2013 on plant protection chemicals that are not registered on the list of permitted plant protection chemicals in Vietnam as follows:

Unregistered plant protection chemicals or those that are removed from the Nomenclature of permitted plant protection chemicals in Vietnam
1. Pesticides that are not registered in the Nomenclature of permitted pesticides in Vietnam comprise include:
a) Any pesticide listed in the Nomenclature of prohibited pesticides;
b) Any pesticide that is of high risk of adversely impacting human health, domestic animals, ecology and environment;
c) Any finished pesticide product or active ingredient that consists of high content of toxicity classified into level I and II according to Globally Harmonized System (briefly called GHS) for the classification and labeling of chemicals, except for bio-pesticides and those used for vapor steam cleaning and rodenticides; termiticides for structural and dyke protection purpose; pesticides for the storage of forestry products which do not serve the purpose of food and herbal ingredients;
d) Any pesticide that have the same brand name as other pesticides listed in the Nomenclature of permitted pesticides in Vietnam;
dd) Any pesticide composed of the active ingredient methyl bromide.

Thus, when falling into one of the above 05 cases, plant protection chemicals are not registered on the List of permitted plant protection chemicals in Vietnam.

From January 16, 2023, what is the list of permitted plant protection chemicals in Vietnam?

On December 2, 2022, the Ministry of Agriculture and Rural Development issued Circular 19/2022/TT-BNNPTNT on the list of permitted plant protection chemicals in Vietnam and the List of plant protection chemicals banned from use in Vietnam.

Accordingly, the list of permitted plant protection chemicals in Vietnam is specified in Clause 1 Article 1 of Circular 19/2022/TT-BNNPTNT as follows:

1. The list of permitted plant protection chemicals in Vietnam, Appendix I attached to this Circular, includes:
a/ Chemicals for farming:
- Pesticides: 689 active ingredients with 1670 trade names.
- Fungicides: 651 active ingredients with 1492 trade names.
- Herbicides: 256 active ingredients with 765 trade names.
- Rodenticides: 8 active ingredients with 37 trade names.
- Plant-growth regulators: 58 active ingredients with 172 trade names.
- Pheromones: 8 active ingredients with 8 trade names.
- Snailicides: 31 active ingredients with 152 trade names.
- Supporting chemicals: 5 active ingredients with 6 trade names.
b) Termiticdes: 14 active ingredients with 21 trade names.
c) Forest product preservatives: 7 active ingredients with 8 trade names.
d) Storage disinfectant: 3 active ingredients with 9 trade names.
dd) Chemicals for golf courses:
- Fungicides: 2 active ingredients with 2 trade names.
- Herbicides: 1 active ingredient with 1 trade name.
- Plant-growth regulators: 1 active ingredient with 1 commercial name.
e) Chemicals for seed treatment:
- Pesticides: 10 active ingredients with 16 trade names.
- Fungicides: 13 active ingredients with 13 trade names.
g) Harvested agricultural product preservatives
- 01 active ingredient with 01 trade name.

See details in Circular 19/2022/TT-BNNPTNT taking effect from January 16, 2023.

From the effective date, Circular 19/2022/TT-BNNPTNT will replace Circular 19/2021/TT-BNNPTNT dated December 28, 2021 on the promulgation of the list of permitted plant protection chemicals in Vietnam and the List of plant protection chemicals banned from use in Vietnam.
