Pursuant to the provisions of Article 6 of Circular 63/2023/TT-BTC supplementing Clause 6, Article 4 of Circular 38/2022/TT-BTC, regulating fees for issuance of construction practicing certificates for foreign contractors as follows:

6. In the case where an organization submits an online application for issuance of certificate of construction capacity, an individual submits an online application for issuance of construction practicing certificate or a foreign submits an online application for issuance of construction permit:
a) From January 01, 2024 to December 31, 2025 inclusive, the fees shall be 80% (eighty percent) of the fees prescribed in clauses 1 and 3 of this Article.
b) From January 01, 2026 onwards, the fees prescribed in clauses 1 and 3 of this Article shall be applied
Thus, based on the above regulations, the fee for issuance of construction practicing certificates online for individuals is as follows:
- The fee for issuance of construction practicing certificates online for individuals from January 1, 2024 to December 31, 2025 is 240,000 VND/license.
- The fee for issuance of construction practicing certificates online for individuals from January 1, 2026 is 300,000 VND/license.

Vietnam: When is a construction practice certificate issued?
Pursuant to the provisions of Clause 1, Article 63 of Decree 15/2021/ND-CP amended by Point a, Clause 18, Article 12 of Decree 35/2023/ND-CP, the provisions are as follows:
Issuance, revocation, renewal of construction practicing certificate
1. The construction practicing certificate shall be issued to:
a) Any individual applying for the practicing certificate for the first time (including cases where the practicing certificate is issued for the first time and the construction is added to the certificate) or adjusting his/her practicing certificate rank;
b) Any individual applying for renewal of the practicing certificate;
c) Any individual applying for adjustments or amendments to eligibility certificate;
d) Any individual applying for reissuance of the practicing certificate in case the old unexpired certificate is lost or damaged or misstated; or
dd) The individuals mentioned in Clause 2 Article 62 of this Decree who wish to convert his/her practicing certificate.

Thus, based on the above regulations, individuals falling into one of the following cases will be granted a construction practicing certificate:
- Any individual applying for the practicing certificate for the first time (including cases where the practicing certificate is issued for the first time and the construction is added to the certificate) or adjusting his/her practicing certificate rank;
- Any individual applying for renewal of the practicing certificate;
- Any individual applying for adjustments or amendments to eligibility certificate;
- Any individual applying for reissuance of the practicing certificate in case the old unexpired certificate is lost or damaged or misstated; or
- The individuals mentioned in Clause 2 Article 62 of Decree 15/2021/ND-CP who wish to convert his/her practicing certificate.
What are the general eligibility requirements for issuance of construction practicing certificates in Vietnam?
Pursuant to the provisions of Article 66 of Decree 15/2021/ND-CP stipulates as follows:
General eligibility requirements for issuance of construction practicing certificates
An individual shall be issued with the practicing certificate if he/she:
1. has full active legal capacity as prescribed by law and obtains a residence permit or work permit if he/she is a foreigner or overseas Vietnamese.
2. has his/her qualifications and experience relevant to requirements of the practicing certificate. To be specific:
a) A Rank-I practicing certificate is awarded to the individual who gains a bachelor's degree in appropriate major and at least 07 years’ experience relevant to requirements of that practicing certificate;
b) A Rank-II practicing certificate is awarded to the individual who gains a bachelor's degree in appropriate major and at least 04 years’ experience relevant to requirements of that practicing certificate;
c) A Rank-III practicing certificate is awarded to the individual who has appropriate qualifications and at least 02 years’ experience relevant to requirements of that practicing certificate with respect to the holder of the undergraduate degree and at least 03 years’ experience with respect to the holder of the associate degree or intermediate diploma.
3. passes the test in the field for which a practicing certificate is sought.
Thus, based on the above regulations, an individual shall be issued with the practicing certificate if he/she has his/her qualifications and experience relevant to requirements of the practicing certificate. To be specific:
- A Rank-I practicing certificate is awarded to the individual who gains a bachelor's degree in appropriate major and at least 07 years’ experience relevant to requirements of that practicing certificate;
- A Rank-II practicing certificate is awarded to the individual who gains a bachelor's degree in appropriate major and at least 04 years’ experience relevant to requirements of that practicing certificate;
- A Rank-III practicing certificate is awarded to the individual who has appropriate qualifications and at least 02 years’ experience relevant to requirements of that practicing certificate with respect to the holder of the undergraduate degree and at least 03 years’ experience with respect to the holder of the associate degree or intermediate diploma.
Circular 63/2023/TT-BTC comes into force from December 1, 2023.
