The Department of Industry and Trade is regulated in Clause 1, Article 1 of Circular 04/2022/TT-BCT which stipulates the position and functions of the Department of Industry and Trade as follows:
Position and Functions
1. The Department of Industry and Trade is a specialized agency under the People's Committee of the province; performs the function of advising and assisting the People's Committee of the province in state management of industry and trade, including sectors and fields: mechanical engineering; metallurgy; electricity; new energy; renewable energy; efficient and economical use of energy; oil and gas (if any); chemicals; industrial explosives; mining and mineral processing industries (excluding common construction materials); consumer industry; food industry; supporting industry; environmental industry; other processing industries; handicrafts; industrial promotion; commercial activities and circulation of goods in the area; sustainable production and consumption; export, import; border trade (for provinces with borders); trade promotion; e-commerce; commercial services; competition management; consumer rights protection and multi-level marketing business management; trade defense; international economic integration; management of industrial clusters in the area.

In Clause 1, Article 1 of Circular 15/2023/TT-BCT, amendments to the functions of the Department of Industry and Trade are stipulated:
The Department of Industry and Trade is a specialized agency under the People's Committee of the province; performs the function of advising and assisting the People's Committee of the province in state management of industry and trade, including sectors and fields:
- Mechanical engineering; metallurgy; electricity; new energy; renewable energy; efficient and economical use of energy; oil and gas (if any); chemicals; industrial explosives; mining and mineral processing industries (excluding common construction materials and cement production); consumer industry; food industry; supporting industry; environmental industry; other processing industries; handicrafts; industrial promotion; commercial activities and circulation of goods in the area;
- Sustainable production and consumption; export, import; border trade (for provinces with borders); logistics services; trade promotion; e-commerce; commercial services; competition management; consumer rights protection and multi-level marketing business management; trade defense; international economic integration; management of industrial clusters in the area.
Thus, according to the provisions of Clause 1, Article 1 of Circular 15/2023/TT-BCT, the logistics service sector will be under the management of the Department of Industry and Trade. Additionally, the cement production sector will no longer fall under the management of the Department of Industry and Trade.

In Clause 5, Article 2 of Circular 04/2022/TT-BCT, supplemented by Clause 9, Article 1 of Circular 15/2023/TT-BCT, the duties of the Department of Industry and Trade regarding logistics services are stipulated as follows:
- Preside over and coordinate in advising to build and implement mechanisms, policies, laws, plans for the development of logistics services and programs and projects for the development of logistics services in the province
- Coordinate, support the development of logistics services and enhance the capacity of logistics enterprises in the province
- Promote, disseminate, develop the market, connect logistics service businesses with production, export, and import businesses in the province.
What are the additional duties of the Department of Industry and Trade in the inspection of construction project acceptance?
Clause 7, Article 1 of Circular 15/2023/TT-BCT adds point q, Clause 4, Article 2 of Circular 04/2022/TT-BCT regarding the duties of the Department of Industry and Trade in the inspection of construction project acceptance as follows:
The state management and inspection of the acceptance of construction projects belonging to specialized industrial construction projects in the province are carried out according to the provisions of the construction law.
Additionally, Clause 5, Article 1 of Circular 15/2023/TT-BCT amends the duties and powers of the Department of Industry and Trade as follows:
5. Abolish paragraph 3, point g, Clause 4, Article 2.
In paragraph 3, point g, Clause 4, Article 2, of Circular 04/2022/TT-BCT, regulations on the management of dam safety and hydroelectric reservoirs within the management scope are specified as follows:
Regarding the management of safety of dams and hydroelectric reservoirs under management scope:
Appraise and submit to the provincial People's Committee for approval: Operating procedure of single hydroelectric dams; Protection plan for dams and hydroelectric reservoirs; Emergency response plan;
Advise the provincial People's Committee to establish the Council to inspect and assess the safety of dam and hydroelectric reservoir projects before the flood season;
Inspect the acceptance work of the investor under the provincial investment decision authority and dams, irrigation and hydroelectric reservoirs built in the area according to law;
Receive the declaration and registration of dam and hydroelectric reservoir safety; summarize, build a database of technical parameters, management information of dams, hydroelectric reservoirs in the area; report to the provincial People's Committee and the Ministry of Industry and Trade;
Receive the application for issuance of Licenses under the provincial People's Committee authority;
Report the general results of the implementation of the operation procedures of hydroelectric reservoirs in the area, to the provincial People's Committee and the Ministry of Industry and Trade.
Thus, from August 22, 2023, the Department of Industry and Trade will have the duty of state management and inspection of the acceptance of construction projects belonging to specialized industrial construction projects in the province and will no longer hold the duty of inspecting the acceptance work of the investor under provincial investment decision authority and dams, irrigation, and hydroelectric reservoirs built in the area.
Note: Circular 15/2023/TT-BCT takes effect from August 22, 2023.
