There is Decree No. 67/2024/ND-CP amending the place of submission for the application requesting the issuance of a laissez-passer effective from August 09, 2024.

What are the changes in the place of submission for laissez-passer applications effective from August 9, 2024, according to Decree No. 67/2024/ND-CP?

Based on Article 7 of Decree 76/2020/ND-CP amended at Clause 3, Article 1 of Decree 67/2024/ND-CP, the place of submission for laissez-passer applications from August 9, 2024, are as follows:

- For applicants for Vietnam-Cambodia border laissez-passer:

+ Directly submit the application at the Immigration Management Agency of the provincial police having a common border with Cambodia, where the applicant’s agency, organization, or enterprise is headquartered, or electronically through the National Public Service Portal or the Public Service Portal of the Ministry of Public Security.

- For applicants for Vietnam-Laos border laissez-passer, submit the application as follows:

+ Vietnamese citizens residing in provinces with a common border with Laos can submit their applications directly at the commune-level police where they reside, district-level police where they reside, or provincial police's Immigration Management Agency where they reside, or electronically through the National Public Service Portal or the Public Service Portal of the Ministry of Public Security;

+ Vietnamese citizens not residing in provinces with a common border with Laos but working at agencies, organizations, enterprises headquartered in provinces with a common border with Laos can submit their applications directly at the provincial police's Immigration Management Agency where their agency, organization, or enterprise is headquartered, or electronically through the National Public Service Portal or the Public Service Portal of the Ministry of Public Security.

- For applicants for entry-exit laissez-passer at the Vietnam-China border area:

+ Vietnamese citizens residing in communes, wards, or commune-level towns adjacent to the Vietnam-China border can submit their applications directly at the commune-level police where they reside, or electronically through the National Public Service Portal or the Public Service Portal of the Ministry of Public Security.

+ Officials working at state agencies headquartered in districts, district-level towns, or provincial cities adjacent to the Vietnam-China border, commissioned to cross the border to China for duties, can submit their applications directly at the district-level police where their agency is headquartered, or electronically through the National Public Service Portal or the Public Service Portal of the Ministry of Public Security.

When will Decree 67/2024/ND-CP take effect?

Pursuant to Clause 1, Article 4 of Decree 67/2024/ND-CP, the effective date is as follows:

Effective Clause

1. This Decree takes effect from August 9, 2024.

Thus, Decree 67/2024/ND-CP is effective from August 9, 2024.

What are the time limits and authorities for resolving laissez-passer application dossiers?

Based on Article 9 of Decree 76/2020/ND-CP amended and supplemented by Clause 4, Article 1 of Decree 67/2024/ND-CP the time limits and authorities for resolving laissez-passer application dossiers are as follows:

(*) Within 03 working days after receipt of a valid dossier, the competent authority as specified in Clauses 1 and 2 of Article 7 of Decree 76/2020/ND-CP as amended by Clause 3, Article 1 of Decree 67/2024/ND-CP issues the laissez-passer and returns the results to the applicant.

In case not issued, a written reply stating the reason must be provided.

To be specific::

(1) The provincial police's Immigration Management Agency having a common border with Cambodia, where the applicant’s agency, organization, or enterprise is headquartered, has the authority to issue the laissez-passer and returns the results to the applicant for the Vietnam-Cambodia border laissez-passer.

(2) For applicants for Vietnam-Laos border laissez-passer, the application is submitted as follows:

+ Commune-level police where the applicant resides or district-level police where the applicant resides or provincial police's Immigration Management Agency where the applicant resides have the authority to issue the laissez-passer and return the results to Vietnamese citizens residing in provinces with a common border with Laos applying for the Vietnam-Laos border laissez-passer.

+ Provincial police's Immigration Management Agency where the applicant’s agency, organization, or enterprise is headquartered has the authority to issue the laissez-passer and return the results to Vietnamese citizens not residing in provinces with a common border with Laos but working at agencies, organizations, enterprises headquartered in provinces with a common border with Laos.

(*) Within 01 working day after receipt of a valid dossier, the competent authority stipulated in Clauses 3 and 4 of Article 7 of Decree 76/2020/ND-CP as amended by Clause 3, Article 1 of Decree 67/2024/ND-CP issues the laissez-passer and returns the results to the applicant.

To be specific::

Within 01 working day after receipt of a valid dossier:

- Commune-level police where the applicant resides have the authority to resolve the applied for laissez-passer dossiers for applicants for entry-exit laissez-passer at the Vietnam-China border area stipulated in Point a, Clause 3, Article 4 of Decree 76/2020/ND-CP.

- District-level police where the applicant’s agency is headquartered have the authority to resolve the applied for laissez-passer dossiers for applicants for entry-exit laissez-passer at the Vietnam-China border area stipulated in Point b, Clause 3, Article 4 of Decree 76/2020/ND-CP.

- In case not issued, a written reply stating the reason must be provided.
