Can a Probationary Party Member Be a Candidate in the Communist Party of Vietnam?
Based on Article 9 of Decision 244-QD/TW in 2014 by the Central Committee, the provisions on candidacy are as follows:
"Article 9. Candidacy
Candidacy is applicable in the following cases:
1- Official Party members can run for office at the Party congress of which they are members. Official representatives of the congress can run for office at the delegates' congress.
2- Official Party members who are not congress delegates can apply to run for office at the congress of the grassroots Party organization or submit an application to be elected to the committee of the delegates from the district level and equivalent or higher.
3- Members of the executive committee can run for election to the standing committee; standing committee members can run for the positions of secretary or deputy secretary; in cases where the executive committee only elects the secretary and deputy secretary without electing the standing committee, committee members have the right to run for the positions of secretary or deputy secretary (except as stipulated in Article 13 of this regulation). In cases where the cell meeting does not elect a cell board, official Party members have the right to run for the positions of secretary or deputy secretary.
4- Members of the Central Committee can run for election to the Politburo or the Secretariat; members of the Politburo can run for the position of General Secretary (except as stipulated in Article 13 of this regulation).
5- Executive committee members can run for election to the inspection committee of their level.
6- Members of the inspection committee can run for the position of deputy head of the inspection committee."
As such, probationary Party members are not allowed to run for office at the Party congress according to the regulations.

How Are the Candidacy Procedures in the Communist Party of Vietnam Regulated?
Based on Article 10 of Decision 244-QD/TW in 2014 by the Central Committee, the regulations are as follows:
"Article 10. Candidacy Procedures
1- Official Party members at the Party congress can run directly at the congress or submit an application to the presidium of the congress. At the grassroots delegates' congress, official Party members who are not congress delegates must submit a candidacy application to the grassroots committee.
2- Official delegates at the delegates' congress can run directly at the congress or submit an application to the presidium of the congress.
3- Committee members can run directly at the committee meeting to be elected to the standing committee (Politburo, Secretariat), inspection committee members.
4- Inspection committee members can run directly at the inspection committee meeting to be elected as deputy head of the inspection committee.
5- Party members who are not congress delegates but wish to run for the committee from the district level and equivalent or higher, must complete their candidacy dossier and submit it to the organizing authority of the convening committee at least 15 working days before the opening day of the congress. The candidacy dossier includes:
- Candidacy application.
- Curriculum vitae certified by the grassroots committee.
- Declaration of personal and family assets and income as per regulations.
- Health certificate.
- Comments from the grassroots committee where they are active and reside.
The grassroots committee where the Party member is active and resides is responsible for the certification and comments about the candidate. Issues requiring verification beyond their authority should be referred to the direct higher-level committee for consideration and decision.
The organizing authority of the convening committee is responsible for cooperating with relevant agencies to check the validity of the dossier and the eligibility of the candidates."
Thus, the candidacy procedures are carried out according to the stated regulations.
Do Probationary Party Members Have the Right to Nominate in the Communist Party of Vietnam?
Based on Article 11 of Decision 244-QD/TW in 2014 by the Central Committee, the regulations are as follows:
"Article 11. Nomination
Nomination is applicable in the following cases:
1- The presidium (chairman) of the congress (meeting) nominates a list of personnel prepared by the convening committee of the congress (meeting).
2- At the Party member congress, official Party members, temporary members, and probationary members all have the right to nominate official Party members from the Party committee or cell to be elected as delegates to the higher-level Party congress or to be elected to their level’s Party committee.
3- At the delegates' congress, official delegates nominate those Party members who are delegates and those official Party members who are not delegates of the congress’s Party committee to be elected to the committee; nominate official delegates of their level’s congress to be elected as delegates to the higher-level Party congress.
4- Executive committee members nominate other executive committee members to be elected to the standing committee at the executive committee meeting; nominate standing committee members to be elected as secretary or deputy secretary (except as stipulated in Article 13 of this regulation).
5- Members of the Central Committee nominate other Central Committee members to be elected to the Politburo, Secretariat, Central Inspection Committee; nominate Politburo members to be elected as General Secretary (except as stipulated in Article 13 of this regulation).
6- Executive committee members nominate other executive committee members to be elected as inspection committee members; nominate inspection committee members to be elected as head of the inspection committee (except as stipulated in Article 13 of this regulation).
7- Inspection committee members nominate other inspection committee members to be elected as deputy head of the inspection committee."
Probationary Party members have the right to nominate official Party members from the Party committee or cell to be elected as delegates to the higher-level Party congress or to be elected to their level’s Party committee.
How Are the Nomination Procedures Conducted in the Communist Party of Vietnam?
Based on Article 12 of Decision 244-QD/TW in 2022 by the Central Committee, the regulations are as follows:
"Article 12. Nomination Procedures
1- At the Party member congress, Party members nominate official Party members of their level’s organization by either direct nomination or by submitting a written nomination to the presidium of the congress. At the grassroots delegates' congress, nominations for official Party members who are not official delegates must be in writing and include the consent of the nominee.
2- At the delegates' congress from the district or equivalent level onwards, official delegates nominate those delegates and official Party members who are not delegates of their level’s Party committee to be elected to the committee; nominate official delegates of their level to be elected as delegates to the higher-level Party congress.
Official delegates nominating Party members who are not delegates to be elected to the committee must submit a written nomination along with the nominee’s dossier as per regulations and obtain the written consent of the nominee.
3- The convening committee is responsible for assisting the congress in verifying and confirming the background and qualifications of the nominees and candidates at the congress."
Thus, the nomination procedures in the Communist Party are carried out according to the stated regulations.
