On July 1, 2024, the Chief Inspector of the Government of Vietnam issued Circular 07/2024/TT-TTCP prescribing the authority and content of inspecting the responsibility for implementing laws on inspection, citizen reception, complaints, denunciations, and anti-corruption in Vietnam.

To whom does Circular 07/2024/TT-TTCP apply?

Based on Article 2 of Circular 07/2024/TT-TTCP, it applies to:

(1) Heads of state administrative agencies, Heads of inspection agencies, Chief inspectors, and members of inspection teams when inspecting the responsibility for implementing laws on inspection, citizen reception, complaints, denunciations, and anti-corruption.

(2) Heads of agencies, organizations, units, and individuals responsible for the implementation of laws on inspection, citizen reception, complaints, denunciations, and anti-corruption.

(3) Other related agencies, organizations, units, and individuals.

How is the content of inspecting the responsibility for implementing laws on inspection in Vietnam regulated?

Based on Article 9 of Circular 07/2024/TT-TTCP, the content of inspecting the responsibility for implementing laws on inspection is regulated as follows:

- Content of state management on inspection

+ The work of advising, constructing, promulgating, and guiding the implementation of regulations on the organization and operation of inspection within the assigned authority (if any);

+ Performing the responsibilities of the Heads of state administrative agencies and Heads of agencies performing inspection functions as prescribed by the Law on Inspection;

+ Implementing information policies and reporting;

+ Establishing, managing, exploiting, using, and storing inspection files and other contents as prescribed by the inspection law.

- Inspection activities

+ Organizational work in forming inspection plans, issuing inspection plans, implementing inspection plans;

+ Performing the duties and exercising the powers of the person issuing the inspection decision, the Chief of the inspection team, and other members of the inspection team during the inspection process;

+ Exercising the authority to issue inspection decisions; developing and approving inspection plans; complying with inspection deadlines; observing procedures of an inspection; reporting inspection results; concluding inspections, publicizing inspection conclusions; handling inspection violations and monitoring, urging, and checking the implementation of conclusions, recommendations, and decisions on handling inspection matters;

+ Supervising the activities of the inspection team, appraising the draft inspection conclusions;

+ Performing the responsibilities of the Heads of state administrative agencies at the same level in issuing documents organizing the implementation of inspection conclusions and directing the implementation of inspection conclusions; handling or requesting, recommending competent state agencies to handle economic violations; handling or requesting, recommending competent state agencies to handle officials and public employees violating the law; applying or requesting, recommending competent state agencies to apply remedial measures to improve mechanisms, policies, and laws.

What are details of the latest instructions for inspecting the responsibility for implementing anti-corruption laws in Vietnam?

Based on Article 13 of Circular 07/2024/TT-TTCP, the content of inspecting the responsibility for implementing anti-corruption laws is as follows:

- Content of state management on anti-corruption

+ Drafting legal documents, programs, and plans for anti-corruption work;

+ Propagating, disseminating, and educating anti-corruption laws;

+ Implementing information policies and reporting on anti-corruption work.

- Implementing regulations on preventing corruption

+ Ensuring transparency and publicity about the organization and activities of agencies, organizations, and units;

+ Establishing and implementing norms, standards, and policies;

+ Implementing the code of conduct for persons having positions and powers;

+ Rotating positions for persons having positions and powers;

+ Carrying out administrative reforms, applying science and technology in management, and promoting non-cash payments.

- Implementing regulations on asset and income control

+ Organizing asset and income declarations; publicizing asset and income declaration forms;

+ Managing, updating asset and income declarations, and information on asset and income control; tracking changes in assets and income of persons having declaration obligations;

+ Verifying assets and income and publicizing the verification conclusions;

+ Protecting, archiving, exploiting, and providing information on asset and income control;

+ Handling individuals violating their obligation to be truthful in declaring assets and income, explaining the origin of additional assets and income; violating the deadline for declaring assets and income and other regulations on asset and income control;

+ Building and managing a national database on asset and income control.

- Detecting corruption

+ Detecting corruption through inspection and self-inspection work;

+ Detecting corruption through resolving reports, denunciations, and reports on corrupt behavior;

+ Detecting corruption through inspection work.

- Handling corruption

+ Handling individuals committing acts of corruption;

+ Recovering corrupt assets;

+ Handling other acts violating anti-corruption laws.

- Handling the responsibility of heads of agencies, organizations, and units in anti-corruption.

- Performing inspection conclusions, audit reports, handling decisions, and complying with superior directives on anti-corruption work.
