On June 24, 2024, the Law on People's Court Organization 2024 was passed by the National Assembly during its 7th session.

Article 142 of the Law on People's Court Organization 2024 stipulates policies on salaries and allowances for Judges, Court Examiners, and Court Clerks as follows:

- The State prioritizes policies on salaries and allowances for Judges, Court Examiners, and Court Clerks.

- Salary and allowance regimes for Judges, Court Examiners, and Court Clerks are regulated by the Standing Committee of the National Assembly as per the proposal of the Chief Justice of the Supreme People's Court.

- Salary and allowance regimes for other officials, public employees, and workers of the Court are implemented according to the law.

- Officials and public employees of the Court who are transferred, rotated, or seconded to various Courts are entitled to policies and benefits as per the law.

What are conditions for the appointment of Judges of People's Courts in Vietnam from January 1, 2025?

Article 95 of the Law on People's Court Organization 2024 stipulates the conditions for the appointment of Judges in Vietnam as follows:

- Individuals who meet the standards stipulated in Article 94 of the Law on People's Court Organization 2024 and fulfill the following conditions can be selected and appointed as Judges of People's Courts; if they are active-duty military officers, they may be selected and appointed as Judges of military courts:

+ Having at least 5 years of legal work experience, possessing the capability to adjudicate and resolve cases within the jurisdiction of the Courts as stipulated by law.

+ Successfully passing the Judge selection examination.

- In special cases, individuals who meet the standards stipulated in items 1, 3, 5, and 6 of Article 94 of the Law on People's Court Organization 2024 may be appointed as Judges of People's Courts; if they are active-duty military officers, they may be selected and appointed as Judges of military courts under the following circumstances:

+ Having at least 10 years of legal work experience, being transferred by authorized entities to hold leadership positions in district-level People's Courts, regional military courts.

+ Having at least 15 years of legal work experience, being transferred by authorized entities to hold leadership positions in provincial People's Courts, High People's Courts, specialized judicial bodies, regional military courts, and equivalent, the Central Military Court.

Judges' Salary Scales for 2024 after statutory pay rate increase to VND 2.34 Million in Vietnam

Based on the Professional Salary Scale for the judicial and prosecutorial sectors issued with Resolution 730/2004/NQ-UBTVQH11, the following applies:

1. Applicable positions for the professional salary scale of the judicial and prosecutorial sectors include:

- Category A3 includes: Judges of the Supreme People's Court, Senior Examiners; Senior Prosecutors of the Supreme People's Procuracy, Senior Inspectors, Senior Investigators.

- Category A2 includes: Judges of provincial People's Courts, Principal Examiners; Provincial Prosecutors, Principal Inspectors, Intermediate Investigators.

- Category A1 includes: Judges of district People's Courts, Examiners, Court Clerks; District Prosecutors, Inspectors, Primary Investigators.

Simultaneously, under Clause 1, Article 5 of Resolution 957/NQ-UBTVQH13 of 2015, Judges of the High People's Courts receive salary and allowance policies of the Supreme People's Court Judges as per current laws until new state policies are issued for salary and allowances.

Judges' salaries are determined as follows:

- Judges of the Supreme People's Court, Judges of the High People's Courts: follow the salary coefficient for Category A3 officials, ranging from 6.20 to 8.00.

- Judges of provincial People's Courts: follow the salary coefficient for Category A2 officials, ranging from 4.40 to 6.78.

- Judges of district People's Courts: follow the salary coefficient for Category A1 officials, ranging from 2.34 to 4.98.

The basic salary from July 1, 2024, will be VND 2,340,000 per month (Clause 2, Article 3 of Decree 73/2024/ND-CP)

According to Circular 07/2024/TT-BNV, the salary for Court Clerks is calculated using the following formula:

(Judges' salaries effective from July 1, 2024) = (Statutory pay rate VND 2,340,000/month) x (Current salary coefficient)

Thus, the 2024 salary scale for Judges, with the statutory pay rate increase to VND 2.34 million, is as follows:

- Judges of the Supreme People's Court, Judges of the High People's Courts:
