Conditions for Obtaining Credit Loans for Released Prisoners under Decision 22/2023/QD-TTg

Article 3 of Decision 22/2023/QD-TTg stipulates the subjects and conditions for obtaining loans as follows:

Subjects and Conditions for Obtaining Loans

The subjects and conditions for obtaining loans include:

1. Subjects eligible for loans

a) Released prisoners, including those who have completed their prison sentences and have been issued a certificate of completion as stipulated by the Law on Execution of Criminal Judgments, and those who have been granted amnesty and have been issued an amnesty certificate as stipulated by the Law on Amnesty;

b) Business establishments, including small and medium enterprises, cooperatives, cooperative groups, business households utilizing labor from released prisoners.

2. Conditions for obtaining loans

a) Released prisoners: Must have a need for loans; must be listed in the registry of released prisoners returning to local residences, complying well with legal regulations, not participating in social evils, as compiled by the communal police and confirmed by the communal People's Committee according to Form No. 01 attached to this Decision. The period from the completion of the prison sentence to the loan application must not exceed 5 years;

b) Business establishments: Must be legally established and operational according to legal regulations; must employ at least 10% of the total workforce as released prisoners meeting the conditions specified in point a of this clause and have labor contracts compliant with labor law; must have a loan plan confirmed by the communal People's Committee where the plan is to be executed according to Form No. 02 attached to this Decision.

3. Released prisoners and business establishments specified in clauses 1 and 2 of this Article must have no outstanding debt at the Vietnam Bank for Social Policies for other credit programs with the same loan purpose for vocational training and production, business, and job creation as specified by law.

Based on Article 4 of Decision 22/2023/QD-TTg, the loan methods are stipulated as follows:

Loan Methods

1. For released prisoners

a) Loans are provided through households. The household representative of the released prisoner acts as the loan applicant and conducts transactions with the Vietnam Bank for Social Policies. In cases where there are no members of legal age (18 years or older) in the household, or the remaining members are incapacitated or lack full civil capacity as stipulated by law, the released prisoner directly applies for the loan at the Vietnam Bank for Social Policies;

b) The Vietnam Bank for Social Policies provides loans through entrustment to political and social organizations.

2. For business establishments

The Vietnam Bank for Social Policies provides direct loans.

The loan methods for released prisoners are implemented as follows:

Purpose of Using Loan Funds by Released Prisoners

Based on Article 5 of Decision 22/2023/QD-TTg, the purposes of using loan funds by released prisoners are stipulated as follows:

- For loans used for vocational training:

+ Expenses for study and living of the released prisoner during their studies at universities (or equivalent), colleges, professional secondary schools, and vocational education institutions established and operating according to Vietnamese law. These expenses include: tuition fees; costs for purchasing books and study materials; costs for meals, accommodation, and transportation.

- For loans used for production, business, and job creation:

+ Expenses for implementing production, business, and job creation activities.

Decision 22/2023/QD-TTg will be effective from October 10, 2023.
