- 1 day before the New Year and 4 days after the New Year- Or 2 days before the New Year and 3 days after the New Year- Or 3 days before the New Year and 2 days after the New Year.

Guidance on Calculating Overtime Pay on Holidays

(1) For employees paid by month, week, or hour:

Based on Clause 1, Article 55 of Decree 145/2020/ND-CP, employees paid by time are entitled to overtime pay when working beyond the normal working hours set by the employer according to Article 105 of the Labor Code 2019 and are calculated as follows:

Overtime pay = Actual hourly wage of the job on a normal working day x At least 150% or 200% or 300% x Number of overtime hours

In which:

For employees working according to policies and paid by month, week, or hour, on public holidays, Tet holidays, and paid days off, employees will receive at least 300% of the actual hourly wage compared to the wage on a normal working day, applied to the overtime hours on public holidays, Tet holidays, and paid days off, not including the salary of the public holidays, Tet holidays, and paid days off for employees paid by the day.

(2) For employees paid by product:

According to Clause 2, Article 55 of Decree 145/2020/ND-CP, employees paid by product are entitled to overtime pay when working beyond the normal working hours to produce extra quantities of products beyond the labor norms as agreed with the employer, calculated as follows:

Overtime pay = Product wage rate of normal working days x At least 150% or 200% or 300% x Number of extra products

In which:

Employees are entitled to at least 300% of the product wage rate on normal working days, applied to extra products on public holidays, Tet holidays, and paid days off.
