Circular 17/2024/TT-BGTVT on standards and conditions for public employee promotion in the transport sector.

On May 30, 2024, the Minister of Transport issued Circular 17/2024/TT-BGTVT stipulating standards and conditions for the promotion of public employees in the transport sector.

Circular 17/2024/TT-BGTVT specifies the standards and conditions for the promotion of public employees in the transport sector, including:

- Standards and conditions for promotion to rank II for public employees in the ferry engineering specialty.

- Standards and conditions for promotion to rank I, rank II for public employees in the following specialties:

+ Maritime project management;

+ Waterway project management;

+ Road project management;

+ Railway project management;

+ Road engineering;

+ Maritime search and rescue;

+ Maritime security information;

+ Inland waterway port authority;

+ Maritime port authority;

+ Aviation port authority;

+ Inspection and verification.

Pursuant to Article 2 of Circular 17/2024/TT-BGTVT, the applicable subjects are as follows:

Circular 17/2024/TT-BGTVT applies to public employees in the transport sector working in public service providers, administrative organizations applying the financial mechanism of public service providers, and relevant organizations and individuals.

What are the general standards and conditions for public employee promotion in the transport sector?

Pursuant to Article 3 of Circular 17/2024/TT-BGTVT, the general standards and conditions are as follows:

(1) Meet the standards and conditions stipulated in Clause 1, Article 32 of Decree 115/2020/ND-CP dated September 25, 2020, by the Government of Vietnam on the recruitment, use, and management of public employees (amended and supplemented by Decree 85/2023/ND-CP dated December 7, 2023, by the Government of Vietnam amending and supplementing several provisions of Decree 115/2020/ND-CP dated September 25, 2020, by the Government of Vietnam on the recruitment, use, and management of public employees).

(2) Have a job position that corresponds to the rank of the public employee's professional title to be considered for promotion.

(3) Be nominated by the head of the competent agency managing the public employees for consideration for promotion.

(4) Meet the requirement for a minimum period of service in the immediately lower-ranked professional title. Specifically:

- Public employees considered for promotion to rank I in the transport sector must have held a rank II professional title or equivalent for at least 06 (six) years up to the deadline for submitting the promotion application;

- Public employees considered for promotion to rank II in the transport sector must have held a rank III professional title or equivalent for at least 09 (nine) years (excluding probation and internship periods) up to the deadline for submitting the promotion application.

What are the standards and conditions for promoting maritime project management public employees from rank II to rank I?

Pursuant to Clause 1, Article 4 of Circular 17/2024/TT-BGTVT, the standards and conditions for promoting maritime project management public employees from rank II to rank I are as follows:

- For public employees in maritime project management, waterway project management, road project management, railway project management, road engineering, during the time of holding the rank II professional title or equivalent, they must meet one of the following standards and conditions:

+ Lead the development of at least 01 (one) ministry-level, provincial-level, or higher science and technology project, scheme, or program assigned to the public employee's unit that has been approved by the competent authority;

+ Lead the development of at least 02 (two) unit-level science and technology projects, schemes, or programs assigned to the public employee's unit that have been approved by the competent authority;

+ Lead the survey of 01 (one) group A project or 02 (two) group B projects that have been approved or serve as the project manager of 01 (one) group A project or 02 (two) group B projects that have been approved and put into use;

+ Lead the survey or lead the inspection or lead the design or lead the verification or lead the review of the design of 01 (one) level I project or 02 (two) level II projects that have been approved or serve as the chief supervisor of 01 (one) level I project or 02 (two) level II projects that have been approved and put into use;

+ Lead the cost estimation for 01 (one) group A project or 02 (two) group B projects, or 01 (one) level I project or 02 (two) level II projects that have been approved;

+ Participate in the management of 01 (one) group A project or 02 (two) group B projects that have been approved and put into use and hold one of the following four professional certifications: level I project management, level I construction design, level I construction supervision, level I construction cost estimation.

Thus, public employees in the transport sector aiming for promotion from rank II to rank I must meet one of the aforementioned standards and conditions.

Circular 17/2024/TT-BGTVT takes effect from July 15, 2024.
