Circular 03/2024/TT-TTCP guiding the Law on Emulation and Commendation for the Inspection sector, how is it?
On March 25, 2024, the Inspector General of the Government of Vietnam issued Circular 03/2024/TT-TTCP guiding the 2022 Law on Emulation and Commendation for the Inspection sector.
Circular 03/2024/TT-TTCP applies to the following subjects:
- Individuals who have worked or are working in Inspection agencies.- Departments, units under the Government Inspectorate of Vietnam; Ministry Inspectorates, and agency-level Inspectorates (hereinafter referred to as Ministry Inspectorates); Inspection agencies under agencies belonging to the Government of Vietnam; Cryptographic Inspection; General Department Inspectorates, Department Inspectorates under Ministries and equivalent; Provincial Inspectorates and centrally controlled cities (hereinafter referred to as Provincial Inspectors); Department Inspectorates; District-level Inspectorates including district, town, city under a province, and city under a centrally controlled city (hereinafter referred to as District Inspectorates), Inspection agencies at special administrative - economic units stipulated by the National Assembly.- Departments and equivalent units under the above-mentioned agencies and units.- Individuals and collectives outside the Inspection sector with achievements contributing to the construction and development of the Inspection sector.- Other cases as decided by the Inspector General of the Government of Vietnam.
The organization and implementation of Circular 03/2024/TT-TTCP are stipulated as follows:
- The Emulation and Commendation Council of the Inspection sector is responsible for guiding, urging, and inspecting the implementation of this Circular.- Heads of departments, units under the Government Inspectorate of Vietnam, Chief Inspectors of Ministries, Chief Inspectors of provinces, centrally controlled cities; Heads of Inspection agencies at agencies under the Government of Vietnam, Chief Cryptographic Inspectors and relevant agencies, units, and individuals are responsible for organizing the implementation of this Circular.- In the implementation process, if there are difficulties or issues, heads of agencies or units promptly inform the Emulation and Commendation Council of the Inspection sector to report to the Inspector General of the Government of Vietnam for review, amendments, and supplementation as appropriate.

What are the rituals for announcing, awarding, and receiving emulation titles and commendation forms?
According to the provisions in Article 26 of Decree 98/2023/ND-CP, the rituals for announcing, awarding, and receiving emulation titles and commendation forms are performed as follows:
Step 1:
The person presiding over the ceremony is a representative leader of the ministry, department, sector, or People's Committee at the provincial level. The organizing unit must prepare the script for announcing, awarding, and receiving the emulation titles and commendation forms.
Step 2:
Announcing decisions to award emulation titles and commendation forms:
- A representative leader from the Emulation and Commendation agency or the organizing unit fully reads out the commendation decision on the emulation title and commendation form;- Announcing the President's Commendation Decision: Before announcing, the person making the announcement invites the Traditional Flag Team (if any), representatives from the Party Committee, government leadership, Vietnam Fatherland Front, Trade Union, Ho Chi Minh Communist Youth Union (or representatives of previous leadership generations of the commended collective) or the individual being commended onto the podium to listen to the commendation decision;- Announcing the commendation decisions on the emulation titles and commendation forms of the Government of Vietnam, the Prime Minister: After announcing, the person making the announcement invites representatives of the commended collectives or individuals named in the commendation decision onto the podium to receive the emulation title or commendation form.
Step 3:
Awarding emulation titles and commendation forms:
- The person awarding emulation titles and commendation forms is the person authorized to decide the commendation of these titles and forms or someone authorized by the decision-maker or a representative of higher-level leaders attending the ceremony; the awarder stands at the center of the podium;- The order of awarding: Attach the Medal (or Badge, Badge with the title) first; then award the Certificate and the Hero Flag (for collectives receiving the Hero title);- For collectives with a Traditional Flag: The awarder attaches the Medal (or Badge with the title) to the upper-right corner of the Traditional Flag. The position of attaching the Medal (or Badge with the title) on the Traditional Flag follows the hierarchy from high to low;For collectives without a Traditional Flag: The awarder awards the Certificate already attached with the Medal (or Badge with the title);- For individuals: The awarder attaches the Medal (or Badge, Badge with the title) to the left chest of the recipient's shirt and then awards the Certificate;- Posthumous awards: The awarder awards the Certificate already attached with the Medal (or Badge, Badge with the title) to the representative of the awarded individual’s family;- The process of awarding emulation titles and commendation forms in special cases such as elderly individuals with weak health, disabled persons, or commendation decisions for many subjects, the organizing agency should seek the guidance of the authorized award decision-maker or an authorized representative or higher-level leaders attending the ceremony to decide.
Step 4:
Receiving emulation titles and commendation forms:
- Receiving forms of commendation within the President's authority: The recipient stands upright in a horizontal line at the center of the podium, listening to the commendation decision;- Receiving emulation titles and commendation forms within the Government of Vietnam’s and the Prime Minister's authority: The recipient is invited to the center of the podium to receive them;- When receiving the Certificate (or Flag), the recipient raises it to chest height, maintaining this position until leaving the podium;- In necessary cases, representative collectives (or individuals, families) being commended may express their opinions after receiving the commendation.
Step 5:
People serving the ritual:
- Do not turn their backs on attendees; stand behind and to the right (dominant hand) of the awarder when presenting the Medal (or Badge, Badge with the title, Certificate, Flag) to the awarder;- Place the Medal (or Badge, Badge with the title, Certificate) on a tray covered with red cloth; Certificates must be framed; hold the tray with both hands when presenting the Medal, Certificate, or Flag to the awarder.
When does Circular 03/2024/TT-TTCP take effect?
According to the provisions in Article 11 of Circular 03/2024/TT-TTCP, Circular 03/2024/TT-TTCP takes effect from May 15, 2024.
