Issuance of Verification Certificates for Relatives of Persons with Meritorious Service and Adjustment, Supplementation of Dossiers for Persons with Meritorious Service Post Removal of Household Registration Books

On December 21, 2022, the Government of Vietnam issued Decree 104/2022/ND-CP on the amendment and supplementation of several articles of decrees related to the submission and presentation of household registration books and paper temporary residence books during administrative procedures and the provision of public services.

In Clause 4, Article 13 of Decree 104/2022/ND-CP, the removal of phrases related to household registration books is stipulated as follows:

4. To remove the phrase “or the household registration book issued before July 1, 2021” at point b clause 1 Article 116 and the phrase “or the household registration book issued before July 1, 2021” at clause 3 Article 130 of Decree 131/2021/ND-CP dated December 30, 2021, instructing the Ordinance on Preferential Treatments for Persons with Meritorious Services to the Revolution.

Thus, from January 1, 2023, post-removal of the household registration book, the phrase "or the household registration book issued before July 1, 2021" shall be excluded from the dossiers for the issuance of verification certificates for relatives of persons with meritorious service and the adjustment and supplementation of dossiers for persons with meritorious service.

Changes in Dossiers and Procedures for Issuance of Verification Certificates for Relatives of Persons with Meritorious Service Post Removal of Household Registration Books

Based on the provisions of Article 116 of Decree 131/2021/ND-CP, amended by Clause 4, Article 13 of Decree 104/2022/ND-CP, the dossiers and procedures for issuing verification certificates for relatives of persons with meritorious service from January 1, 2023 (post-removal of household registration books) are as follows:

- Persons with meritorious service or their relatives shall submit an application for the issuance of a verification certificate for relatives of persons with meritorious service to the Commune People's Committee of the place of permanent residence, accompanied by a certified copy of one of the following documents:

+ Certificate of Persons with Meritorious Service or Commendation for Revolutionary, Resistance War, National Defense, or International Duty Activity who were Captured and Imprisoned by the Enemy;

+ Order, Medal of Resistance; Order, Medal of Victory; Commemorative Medal "Nation Remembers"; Certificate of "Contribution to the Nation";

+ Documents issued by a competent authority certifying the relationship with the persons with meritorious service: Citizen Identification Card.

- The Commune People's Committee of the place of permanent residence: Within 5 working days from the date of receipt of the complete dossier, they are responsible for issuing the verification certificate for relatives of persons with meritorious service.

Thus, the dossiers and procedures for issuing verification certificates for relatives of persons with meritorious service post-January 1, 2023, post-removal of household registration books are as stated above.

Changes in Dossiers and Procedures for Amending, Supplementing Personal Information in Dossiers of Persons with Meritorious Service Post Removal of Household Registration Books

Based on the provisions of Clause 3, Article 130 of Decree 131/2021/ND-CP and Clause 4, Article 13 of Decree 104/2022/ND-CP, the dossiers and procedures for amending, supplementing personal information in the dossiers of persons with meritorious service post-removal of household registration books are as follows:

- For dossiers of persons with meritorious service managed by the military and police, the procedures are as follows:

+ Persons with meritorious service shall submit an application for amendment, supplementation of personal information in the dossiers of persons with meritorious service, accompanied by a certified copy of the Citizen Identification Card or Identity Card to correct information to the managing agency or unit of the dossiers of persons with meritorious service.

+ The Ministry of Defense and the Ministry of Public Security provide guidance on the process for amending, supplementing personal information in the dossiers of persons with meritorious service. The processing time shall not exceed 30 days from the receipt of the application.

- For dossiers of persons with meritorious service managed by the Department of Labor, Invalids and Social Affairs, the procedures are as follows:

+ Persons with meritorious service; relatives of martyrs or persons receiving allowance for the ritual worship of martyrs; relatives of deceased persons with meritorious service shall submit an application to the Department of Labor, Invalids and Social Affairs, where the dossiers of persons with meritorious service are managed, accompanied by certified copies of the following documents:

+ For persons with meritorious service: Citizen Identification Card or Identity Card;+ For relatives of martyrs or persons receiving allowance for the ritual worship of martyrs, relatives of deceased persons with meritorious service: Citizen Identification Card or Identity Card of the person intended to correct information.

+ The Department of Labor, Invalids and Social Affairs (DOLISA) has 12 days from the receipt of the complete dossier to check, compare information, and submit a proposal along with documents and certified copies requesting amendment, supplementation of information to the competent authority for resolution.

+ The DOLISA has 12 days from the receipt of the proposal for amendment, supplementation of information from the competent authority to issue a decision on amendment, supplementation of information in the dossiers of persons with meritorious service and notify the information adjustment to the Ministry of Labor, Invalids and Social Affairs (MOLISA).

+ In case of amending, supplementing information in the dossiers of martyrs where it is necessary to reissue the Certificate of "Nation Remembers", the DOLISA shall notify the information adjustment along with a proposal to the MOLISA.

+ The MOLISA shall perform its responsibilities as stipulated in point e, clause 2, Article 21 of Decree 131/2021/ND-CP.

Thus, the dossiers and procedures for amending, supplementing personal information in the dossiers of persons with meritorious service from January 1, 2023, post-removal of household registration books are executed as described above.

Decree 104/2022/ND-CP will be effective from January 1, 2023.
