What are the security guard measures for international guests visiting and working in Vietnam from January 1, 2025?

Under Clause 7, Article 1 of the Law on Amendments to Law on Security Guard Forces 2024, the security guard measures for international guests visiting and working in Vietnam are stipulated as follows:

(1) For heads of state, the Government of Vietnam of other countries visiting and working in Vietnam, security guard measures are applied according to the provisions of Clause 1, Article 11a of the Law on Amendments to Law on Security Guard Forces 2024.

For heads of legislative bodies of other countries visiting and working in Vietnam, security guard measures are applied according to the provisions of Clause 1, Article 11a of the Law on Amendments to Law on Security Guard Forces 2024 on the basis of reciprocity, mutual respect, and external relations requirements.

(2) For deputies of heads of state, the Government of Vietnam of other countries visiting and working in Vietnam, security guard measures are applied according to Points a, c, d, and đ of Clause 4, Article 11a of the Law on Amendments to Law on Security Guard Forces 2024.

For deputies of heads of legislative bodies of other countries visiting and working in Vietnam, security guard measures are applied according to Points a, c, d, and đ of Clause 4, Article 11a of the Law on Amendments to Law on Security Guard Forces 2024 based on reciprocity, mutual respect, and external relations requirements.

(3) For guests of the General Secretary of the Central Committee of the Communist Party of Vietnam, the President, the Chairman of the National Assembly, the Prime Minister of Vietnam, or other guests upon the request of the Head of the Central Foreign Affairs Committee, the Chairman of the National Assembly’s Foreign Affairs Committee, or the Minister of Foreign Affairs not falling under subjects defined in Clauses 1 and 2, Article 12a of the Law on Security Guard Forces 2017 (amended by Clause 7, Article 1 of the Law on Amendments to Law on Security Guard Forces 2024), the security guard measures applied upon their visit and work in Vietnam will be based on external relations requirements, international practices, the visitors' requests, and actual conditions, in accordance with Clause 1, Article 11a of the Law on Amendments to Law on Security Guard Forces 2024.

(4) The Minister of Public Security specifies the security guard measures stipulated in Article 12a of the Law on Security Guard Forces 2017 (amended by Clause 7, Article 1 of the Law on Amendments to Law on Security Guard Forces 2024).

From January 1, 2025, what are the security guard policies for international guests visiting and working in Vietnam?

Under Article 12 of the Law on Security Guard Forces 2017 amended by Clause 6, Article 1 of the Law on Amendments to Law on Security Guard Forces 2024, the security guard policies for international guests visiting and working in Vietnam are as follows:

(1) For heads of state, the Government of Vietnam:

Heads of state, the Government of Vietnam from other countries visiting and working in Vietnam enjoy security guard policies according to Clause 1, Article 11 of the Law on Security Guard Forces 2017 (amended by Clause 4, Article 1 of the Law on Amendments to Law on Security Guard Forces 2024) and are provided with escort vehicles according to the state’s external ceremonial protocol.

Heads of legislative bodies of other countries visiting and working in Vietnam enjoy security guard policies according to Clause 1, Article 11 of the Law on Security Guard Forces 2017 (amended by Clause 4, Article 1 of the Law on Amendments to Law on Security Guard Forces 2024) based on reciprocity, mutual respect, external relations requirements, and are provided with escort vehicles according to the state’s external ceremonial protocol.

(2) For deputies of heads of state, the Government of Vietnam:

Deputies of heads of state, the Government of Vietnam from other countries visiting and working in Vietnam enjoy security guard policies according to Clause 4, Article 11 of the Law on Security Guard Forces 2017 (amended by Clause 4, Article 1 of the Law on Amendments to Law on Security Guard Forces 2024).

Deputies of heads of legislative bodies of other countries visiting and working in Vietnam enjoy security guard policies according to Clause 4, Article 11 of the Law on Security Guard Forces 2017 (amended by Clause 4, Article 1 of the Law on Amendments to Law on Security Guard Forces 2024) on the basis of reciprocity, mutual respect, external relations requirements.

(3) For guests of key leaders, and senior leaders of Vietnam: Guests of the General Secretary of the Central Committee of the Communist Party of Vietnam, the President, the Chairman of the National Assembly, the Prime Minister of Vietnam, or other guests upon the request of the Head of the Central Foreign Affairs Committee, the Chairman of the National Assembly’s Foreign Affairs Committee, or the Minister of Foreign Affairs not falling under subjects defined in (1) and (2) when visiting and working in Vietnam, the security guard policies applied will be based on external relations requirements, international practices, the guests' requests, and actual conditions, under Clause 1, Article 11 of the Law on Security Guard Forces 2017 (amended by Clause 4, Article 1 of the Law on Amendments to Law on Security Guard Forces 2024).

What does international cooperation in security guard work include?

According to Article 8 of the Law on Security Guard Forces 2017 regarding international cooperation in security guard work:

- Cooperation activities between Vietnam's Security Guard Forces and Foreign Security Guard Forces on the territory of Vietnam and abroad are carried out according to international treaties, and international agreements to which the Socialist Republic of Vietnam is a party, or according to direct agreements between Vietnam and the relevant country on the principle of reciprocity, ensuring conformity with Vietnamese law and international practices.

- The content of cooperation includes:

+ Exchange of information on security guard work;

+ Coordination in implementing security guard measures and policies;

+ Training and exercises to enhance protection capabilities, and training skills in security guard work;

+ Technical support, specialized vehicles, weapons, and equipment serving security guard work;

+ Implementation of other cooperation contents.
