Will the 2024 Police payrolls include official duty allowances after salary reform in Vietnam under the Resolution 27-NQ/TW in 2018?

Currently, pursuant to Circular 24/2012/TT-BCA, the entitlement to official duty allowances in the People's Public Security forces is as follows:

(*) Applicable subjects for official duty allowances:

- Applicable to officers, non-commissioned officers, soldiers, workers, employees of the Police and contract workers receiving salaries and allowances from the state budget in the People's Public Security, including:

- Operational officers and non-commissioned officers; officers and non-commissioned officers with technical expertise.

- Non-commissioned officers and soldiers serving for a fixed term.

- Workers, employees of the Police, and contract workers (according to the Ministry's quota) receiving salaries based on the payrolls issued with Decree 204/2004/ND-CP dated December 14, 2004, of the Government on the salary regime for officials, civil servants, public employees, and armed forces.

(*) Allowance rates and calculation formula:

- The official duty allowance is equal to 25% of the salary level, grade-level salary, or rank-level allowance, plus leadership position allowance, and seniority allowance (if applicable).

- The monthly amount of official duty allowance is calculated as follows:

The National Assembly has voted to approve the State budget estimate for 2024 on the morning of November 10. Accordingly, the Resolution recommends implementing comprehensive salary policy reforms according to Resolution 27-NQ/TW in 2018 on salary policy reforms for officials, civil servants, public employees, armed forces, and workers in state-owned enterprises, issued by the Central Executive Committee, starting from July 1, 2024.

Pursuant to Resolution 27-NQ/TW in 2018, the following allowances will be abolished:

+ Seniority allowances (except for the military, police, and essential forces to ensure salary proportionality with officials).

+ Leadership position allowances (as salary grades for leadership positions are determined within the political system).

+ Allowances for party and political-social organizations' service (as they have been included in the base pay).

+ Official duty allowances (as they have been included in the base pay).

+ Hazardous and dangerous allowances (as work conditions with hazardous and dangerous factors have been included in profession-based allowances).

Therefore, when implementing the salary reform in 2024, the police salary will no longer include the official duty allowances according to the guidance of Resolution 27-NQ/TW in 2018. However, the essence of the official duty allowances will be incorporated into the base pay, so the amount received from the basic official duty allowances will be restructured within the base pay.

Furthermore, the ministries are currently completing the list of positions and will submit it to the Government in the near future. Therefore, detailed guidelines for the police salary in 2024 will be provided in the coming time.

Vietnam: Will 2024 Police payrolls increase or decrease after annulling some allowances?

From 2025, the Government will continue to adjust salaries in the payrolls to increase by an average of about 7% per year. This means that after implementing the salary reform with new payrolls and higher salaries compared to the current ones, the armed forces will still receive an additional 7% salary increase annually.

The 7% salary increase is intended to compensate for inflation and contribute to improving income levels in line with GDP growth, and will continue until the minimum salary level in the public sector is equal to or higher than the minimum salary level in Region 1 of the business sector.

Therefore, when implementing the salary reform, the police salary will increase by an average of about 7% per year from 2025 and will ensure that the minimum police salary is equal to or higher than the minimum salary level in Region 1 of the business sector.

Pursuant to the provisions of Clause 2, Article 2 of Circular 24/2012/TT-BCA, the following individuals are not eligible for official duty allowances:

- Those who are in temporary employment or probationary period at police units or localities.

- Trainees paying tuition fees studying at academies and schools within and outside the People's Public Security forces.

- Officers, non-commissioned officers, officials, workers, employees, and contract workers in the enterprises of the People's Public Security forces.

- Contract workers who are not within the quota of the Ministry, or do not receive salaries from the state budget, or receive salaries based on fixed amounts or agreed-upon amounts (not classified according to pay steps, payrolls regulated by the State).

- Officers, non-commissioned officers, soldiers, workers, police employees, and contract workers who have retired, discharged, transferred to other sectors, resigned, or terminated their labor contracts before May 1, 2012.

In addition, for those eligible for official duty allowances according to regulations, they will not be entitled to official duty allowances during the following periods:

- The period of working, studying, or being on a mission abroad will receive 40% of the salary as stipulated in Clause 4, Article 8 of Decree 204/2004/ND-CP dated December 14, 2004, of the Government on the salary regime for officials, civil servants, public employees, and armed forces.

- The continuous period of personal leave of absence of more than 01 month.

- The period of leave of absence receiving social insurance benefits as prescribed by the law on social insurance.

- The period of leave of absence awaiting retirement benefits.

- The period of attending training courses for new soldiers of non-commissioned officers or soldiers with fixed terms in the People's Public Security forces.

- The period of being suspended from duty or being temporarily detained or imprisoned.
