Honking Car Horns During What Hours is Legal?

According to the provisions of Clause 12, Article 8 of the 2008 Road Traffic Law on this content as follows:

Prohibited Acts

1. Destroying roads, bridges, tunnels, ferry terminals, traffic signals, markers, signs, convex mirrors, median strips, drainage systems, and other constructions and equipment belonging to the road traffic infrastructure.

2. Illegally excavating, drilling, or cutting roads; placing or leaving obstacles on roads unlawfully; placing or scattering sharp objects, or pouring slippery substances on the road; illegally placing materials, waste, or litter on roads; opening roads, or connecting roads unlawfully to the main road; encroaching upon or illegally using the land of roads, road safety corridors; arbitrarily opening sewer covers, dismantling, moving unauthorized, or altering road constructions.

3. Illegally using roadways, sidewalks, or streets.

4. Operating motorized vehicles or specialized vehicles not meeting safety and environmental protection standards in road traffic.

5. Modifying assemblies, components, or accessories of motor vehicles to temporarily meet the vehicle's technical standards during inspection.

6. Street racing, encouraging racing, organizing unauthorized racing, zigzagging, or swinging vehicles.

7. Operating road traffic vehicles while under the influence of narcotic substances.

8. Operating road traffic vehicles with a blood or breath alcohol concentration.

9. Operating motor vehicles without a valid driving license as prescribed.

Operating specialized road traffic vehicles without a legal knowledge enhancement certificate for road traffic, or without a valid certificate or driving license for operating these vehicles.

10. Allowing another person who does not meet conditions to operate a motor vehicle on public roads.

11. Operating a motor vehicle exceeding the speed limit, vying for roads, or overtaking recklessly.

12. Honking continuously; honking from 10:00 PM to 5:00 AM; using air horns, or high beams in urban and densely populated areas, except for priority vehicles on duty as prescribed by this Law.

Thus, the following horn usage regulations must be adhered to:

- Continuous honking is not allowed.- Honking is not allowed from 10:00 PM to 5:00 AM in urban and densely populated areas, except for priority vehicles on duty.- Air horns are not allowed in urban and densely populated areas.

In addition, according to Clause 3.1 and Clause 3.2, Article 3 of the National Technical Regulation QCVN 41:2019/BGTVT, the definitions are as follows:

+ Urban roads are roads within the administrative boundaries of inner cities, inner district-level towns, and commune-level towns.

+ Roads passing through densely populated areas are road sections located within cities, inner district-level towns, inner commune-level towns and areas where residents live densely along the road, with activities potentially affecting road traffic safety and marked by signs as roads passing through densely populated areas (can be determined separately for each road direction if necessary).

Penalties for Illegal Honking of a Car Horn

According to point a, point g, Clause 1, Article 5 of Decree 100/2019/ND-CP and point b, Clause 3, Article 5 of Decree 100/2019/ND-CP (amended and supplemented by point a, point i, Clause 34, Article 2 of Decree 123/2021/ND-CP) on the misuse of car horns for violating road traffic rules:

- A fine of VND 300,000 to VND 400,000 for honking a car horn in urban or densely populated areas between 10:00 PM and 5:00 AM, except for priority vehicles performing their duties as per regulations.- A fine of VND 300,000 to VND 400,000 for honking a car horn where there is a "no honking" sign.- A fine of VND 800,000 to VND 1,000,000 for continuous honking; using air horns in urban and densely populated areas, except for priority vehicles on duty as per regulations.

Penalties for Illegal Honking of a Motorbike Horn

According to point a, point n, Clause 1, Article 6 of Decree 100/2019/ND-CP with some replacements by point e, Clause 34, Article 2 of Decree 123/2021/ND-CP; point c, Clause 3, Article 6 of Decree 100/2019/ND-CP, the administrative penalties for misusing motorbike horns are as follows:

- A fine of VND 100,000 to VND 200,000 for honking from 10:00 PM to 5:00 AM in urban and densely populated areas, except for priority vehicles performing their duties as prescribed.- A fine of VND 100,000 to VND 200,000 for honking where there is a "no honking" sign.- A fine of VND 400,000 to VND 600,000 for continuous honking in urban and densely populated areas, except for priority vehicles on duty as prescribed.
