According to Notice 5015/TB-LDTBXH 2023, officials and public employees of administrative, non-business agencies, political organizations, and socio-political organizations (hereinafter referred to as officials and public employees) will have the 2024 Lunar New Year off from:

Thursday, February 8, 2024 (29th day of the twelfth lunar month of the Year of the Cat) to Wednesday, February 14, 2024 (5th day of the first lunar month of the Year of the Dragon).

In Notice 5015/TB-LDTBXH 2023 regarding the Lunar New Year and National Day holidays 2024 for officials and public employees and workers, the Ministry of Labor, Invalids, and Social Affairs stated that for employees not belonging to administrative, non-business agencies, political organizations, or socio-political organizations (private sector employees), employers can choose one of the following three options for the Lunar New Year holiday:

(1) Selecting one day at the end of the Year of the Cat and four days at the beginning of the Year of the Dragon.

(2) Selecting two days at the end of the Year of the Cat and three days at the beginning of the Year of the Dragon.

(3) Selecting three days at the end of the Year of the Cat and two days at the beginning of the Year of the Dragon.

- Additionally, employers must notify employees of the Lunar New Year 2024 holiday plan at least 30 days in advance.- If the weekly day off coincides with a public holiday as stipulated in Clause 1, Article 112 of the Labor Code 2019, employees are entitled to a compensatory day off as per Clause 3, Article 111 of the Labor Code 2019.- It is encouraged for employers to apply the same Tet holiday schedule for private sector employees as for officials and public employees.

How is the salary for employees working on Tet holidays calculated?

According to Article 98 of the Labor Code 2019 regarding overtime pay and night work pay:

1. An employee who works overtime is entitled to a salary calculated based on the actual hourly wage rate or the actual wage paid for the job as follows:

a) On regular days, at least 150%;

b) On weekends, at least 200%;

c) On holidays or Tet (Lunar New Year), paid days off, at least 300%, not including the daily wage for holidays, Tet, or paid days off for employees with monthly wages.

2. An employee working at night is entitled to an additional 30% wage based on the hourly wage rate or the actual wage paid for the job on regular working days.

3. An employee working overtime at night is entitled to an additional 20% wage based on the actual wage paid for the job done during the day on regular working days or weekends or holidays or Tet.

4. The Government of Vietnam shall detail this Article.
