Pursuant to the Law on Government Organization dated June 19, 2015; Law on amendments to the Law on Government Organization and the Law on Organization of Local Governments dated November 22, 2019;
Pursuant to the Law on Competition dated June 12, 2018;
Pursuant to the Government’s Decree No. 03/2023/ND-CP dated February 10, 2023 on functions, tasks, powers and organizational structure of the National Competition Commission;
At the request of the Minister of Industry and Trade;
The Prime Minister promulgates Decision on bonuses paid to members of National Competition Commission, competition presiding officers, expert witnesses, interpreters, and witnesses.
Article 1. Scope and regulated entities
1. This Decision provides for bonuses paid to members of the National Competition Commission, competition presiding officers, expert witnesses, interpreters, and witnesses.
2. This Decision applies to members of the National Competition Commission, competition presiding officers, expert witnesses, interpreters, witnesses and relevant organizations and individuals.
Each member of the National Competition Commission is entitled to receive a bonus of 2.340.000 VND/person/month.
1. The President of the anti-competitive settlement council is entitled to receive a bonus of 150.000 VND/day.
2. A member of the anti-competitive settlement council, an investigator who investigates a competition case and participates in a hearing or a hearing clerk is entitled to receive a bonus of 100.000 VND/person/day.
3. An expert witness invited by the anti-competitive settlement council is entitled to receive a bonus of 100.000 VND/person/day.
4. An interpreter invited by the anti-competitive settlement council to give interpretation in a hearing is entitled to receive a bonus according to regulations on interpretation and translation costs included in expenditures on reception of foreign guests and organization of international conferences and seminars in Vietnam.
5. A witness summoned by the anti-competitive settlement council to the hearing is entitled to receive a bonus of 100.000 VND/person/day.
1. An investigator is entitled to receive a bonus of 80.000 VND/person/day during the duration he/she is assigned to investigate a competition case.
2. An interpreter summoned and invited by the competition case investigation agency to participate in a working session during investigation into the competition case is entitled to receive a bonus according to regulations on interpretation and translation costs included in expenditures on reception of foreign guests and organization of international conferences and seminars in Vietnam.
3. An expert witness or witness summoned and invited by the competition case investigation agency to participate in a working session during investigation into the competition case is entitled to receive a bonus of 100.000 VND/person/day.
1. The President of the anti-competitive settlement council is entitled to receive a bonus of 150.000 VND/day.
2. A member of the anti-competitive settlement council or the anti-competitive complaint resolution council is entitled to receive a bonus of 100.000 VND/person/day.
Funding for payment of bonuses to members of the National Competition Commission, competition presiding officers, expert witnesses, interpreters, and witnesses shall be covered by state budget and included in annul state budget estimates made by the Ministry of Industry and Trade according to regulations of the law on state budget.
1. This Decision enters into force from April 01, 2025.
2. This Decision replaces the Decision No. 35/2016/QD-TTg dated August 23, 2016 of the Prime Minister.
Article 8. Responsibility for implementation
Ministers, Heads of ministerial authorities, Heads of relevant authorities, the President and members of the National Competition Commission and relevant organizations and individuals shall be responsible for implementing this Decision.
