Regarding this issue, LawNet would like to answer as follows:

1. Who is eligible to be selected as an officer for the Military Procuracy?

According to Article 6 of Circular 113/2015/TT-BQP, the sources for selecting officers of the Military Procuracy include:

- Active military personnel, defense workers; cadres, civil servants, public employees, and citizens outside the Army who have a doctorate in law, a master's degree in law, or a bachelor's degree in law, a regular system, or a better grade.

In case of volunteering to work in units stationed in highlands, border areas, islands, or areas with extremely difficult socio-economic conditions as prescribed by the Government,
can choose to graduate with a bachelor's degree in law, a full-time system, and an average degree.

- Active-duty soldiers, defense workers, and high school graduates who have been admitted to a military university will be selected to train at a full-time law university.

- Persons who fully meet the conditions and standards of working titles in the military procuracies.

2. The process of selecting officers for the Military Procuracy

Specifically, Article 8 of Circular 113/2015/TT-BQP stipulates the process of selecting officers of the Military Procuracy as follows:

(1) Selection process for those who are university graduates, cadres, civil servants, and public employees outside the Army

- Develop a plan to select targets for officers of the Military Procuracy:

+ Annually, based on staffing needs, actual situation of cadres, agencies, and cadres at military zone level and the equivalent, assume the prime responsibility for, and coordinate with the military procuracies of the same level in, formulating plans and targets for cadre selection, and reporting them to political agencies for appraisal and submission to the standing party committees of their respective levels.

+ Based on the resolution of the standing party committee at their level, the military zone-level cadres and agencies shall summarize plans and criteria for cadre selection and report it to the General Department of Politics (via the Department of Personnel).

+ The Department of Cadres shall summarize and discuss with the Central Military Procuracy to propose targets for selecting officers of the Military Procuracy, and report it to the Head of the General Department of Politics and the Ministry of National Defense for consideration and decision.

- Proposing personnel to select officers of the Military Procuracy:

+ Military procuracies of military zones and the equivalent

After being notified of the cadre selection quota, the Military Procuracy of the military zone and the equivalent shall publicly announce it in the mass media; coordinate with functional agencies at the same level to set up a selection council and organize pre-qualification on dossiers; conduct verification for the pre-qualification cases; organize an entrance examination or selection examination (in case no entrance exam is held).

Synthesizing and proposing personnel to select and report to the Central Military Procuracy for appraisal; after having the appraisal results of the Central Military Procuracy (in writing), summarizing and reporting to political agencies (via cadres) and submitting them to the standing party committee at their level.

+ Personnel agencies of military zones and the equivalent

Summarizing personnel to select cadres proposed by the Military Procuracy of the same level, report to the Head of the Political Department for appraisal and the Standing Party Committee of the same level for consideration and recommendation.

+ Completing applications and procedures for reporting to the General Department of Politics and the Ministry of National Defense (via the Department of Personnel) for consideration and decision.

- Those who are recruited into the contingent of cadres and work at the Military Procuracy must go through a training program on military knowledge according to the regulations of the Ministry of National Defense.

(2) The selection process for active-duty military personnel and defense workers shall comply with the regulations of the Ministry of National Defense.

3. Rights and obligations of officers of the Military Procuracy

3.1. Obligations of officers of the Military Procuracy

Officers of the military procuracies have the following obligations:

- Strictly abiding by the lines, guidelines, and policies of the Party, State laws, military discipline, and working regulations of the People's Procuracy.

- Good performance of responsibilities and tasks, ready to receive and complete all assigned tasks.

- Regularly studying and researching to improve qualifications in all aspects; respecting professional honor, striving and train to become an exemplary and honest cadre on ethics, prudence, and humility; preserving and promoting the fine traditions of the Vietnam People's Army and the Military Procuracy.

3.2. Benefits of Officers of the Military Procuracy

According to Article 5 of Circular 113/2015/TT-BQP, officers of the Military Procuracy have the following rights:

- To be arranged and used according to the prescribed titles, in accordance with the trained professional qualifications and the capacity to perform the assigned tasks.

- To study and improve their qualifications in all aspects; encourage and create conditions for talent development; if they satisfy all conditions and criteria, they may be considered for entrance examination and training according to the provisions of Chapter II of Circular 113/2015/TT-BQP.

- To enjoy all regimes, benefits, and policies as prescribed by the Army and the People's Procuracy.
