On April 11, 2023, issued by the Minister of Culture, Sports and Tourism Decision 912/QD-BVHTTDL in 2023 stipulates the functions, tasks, powers and organizational structure of the Copyright Office of Vietnam.

1. Tasks and powers of the Copyright Office of Vietnam

- Submitting to the Minister draft legal documents, strategies, mechanisms, policies, decentralization of state management, plans, programs, projects, and schemes on copyright and related rights protection, and the development of cultural industries; drafting plans, participating in negotiations, proposing to sign, join, reserve, amend, supplement, extend, and terminate the validity of international treaties and international commitments, an international cooperation program on copyright and related rights, the development of cultural industries, and the implementation organization after being approved by competent authorities

- Guiding, implementing, providing, cooperating, ordering, using, and guaranteeing copyright to works, including related rights to performances, phonograms, video recordings, and broadcasts.

- Organizing the implementation of measures to develop cultural industries within the scope of state management by the Ministry; protecting the legitimate rights and interests of organizations, individuals, the State and society in terms of copyright and related rights.

- Managing and exploiting copyright in literary, artistic, and scientific works and related rights for performances, phonograms, video recordings, and broadcasts in which the State is the representative owner or the State is the representative for management; receiving the transfer of copyright and related rights of organizations and individuals to the State according to the provisions of law.

- Advising and assisting the Minister in directing, guiding, and organizing training and examination of expertise in copyright protection and related rights and developing cultural industries for branches, localities, units, and social organizations in accordance with the law.

- Managing activities of organizations representing collective copyrights and related rights and providing consultancy and services on copyright and related rights in accordance with law.

- Managing and organizing the assessment of copyright and related rights; issuing, reissuing, and revoked assessor cards and assessment organization certificates in accordance with law.

- Granting, re-granting, renewing, and invalidating copyright registration certificates and related rights registration certificates; establishing and managing the national register of copyright and related rights; and copyright certification.

- Coordinating in organizing educational activities, propagating and disseminating legal knowledge, mechanisms, and policies on copyright and related rights, and developing cultural industries.

- Organizing information, communication, statistics, publishing activities on copyright, related rights, and cultural industry.

- Assuming the prime responsibility for, and coordinating with relevant competent state agencies in, examining and settling complaints and denunciations about copyright and related rights in accordance with law. Cooperate with competent state agencies in inspecting and handling violations of the law on copyright and related rights in accordance with the law.

- Proposing to reward organizations and individuals with achievements in the protection of copyright and related rights and the development of cultural industries in accordance with the law.

- Implementing international cooperation and international integration on copyright, related rights, and cultural industry under the Minister's decision.

- Guiding and organizing the approval of the translation of works from foreign languages into Vietnamese and the reproduction of works for teaching and research for non-commercial purposes as defined in the Annex to the Berne Convention for the protection of literary and artistic works.

- Guiding and organizing the exploitation and use of published works, phonograms, and video recordings of Vietnamese organizations and individuals, but the copyright owner cannot be found or cannot be identified. , the related rights holder.

- Advising and assisting the Minister in approving and adjusting the royalty payment schedule and methods developed by the collective representative organizations of copyright and related rights.

- Advising and assisting the Minister to coordinate with the Ministry of Science and Technology in formulating general guidelines, policies, and laws on the protection of intellectual property rights; synthesizing general information on intellectual property; implementing joint international cooperation programs and projects on intellectual property; and other related joint work.

- Advising and assisting the Minister to assume the prime responsibility for, and coordinate with concerned ministries and branches in, formulating common legal guidelines and policies on the development of cultural industries, synthesizing general information on cultural industries, and implementing joint international cooperation programs and projects on the development of cultural industries.

- Advising and assisting the Minister in guiding the implementation of the Strategy for the development of cultural industries.

- Implementing administrative reform and digital transformation contents according to the programs and plans of the Ministry.

- Managing the organizational apparatus, civil servants, public employees, and employees; implementing regimes and policies towards civil servants, public employees, and employees under the management of the Department according to the provisions of law and the decentralization of the Minister.

- Manage and use finances, assets, and other resources assigned in accordance with law.

- Perform other tasks assigned by the Minister and in accordance with law.

2. Organizational structure of Copyright Office of Vietnam

The organizational structure of the Copyright Office of Vietnam includes:

- Director and Deputy Directors.

- Professional departments:

+ Office of the Department;

+ Department of Management and International Cooperation on copyright and related rights;

+ Cultural Industry Management Department;

+ Office for registration of copyright and related rights.

- Affiliated public non-business units:

Center for assessment, information and transfer of copyright and related rights.

Director of Copyright Office of Vietnam shall:

+ Take responsibility before the Minister and before the law for the performance of assigned tasks and powers;

+ Be responsible for stipulating the functions, tasks, and organizational structure of specialized and professional departments and affiliated public non-business units;

+ Arrange and arrange civil servants, public employees, and employees according to the structure of titles and professional standards for professional departments and affiliated public non-business units;

+ Develop and issue Regulations on the organization and operation of the Department.

Decision 912/QD-BVHTTDL takes effect from April 11, 2023.
