Regarding this issue, LawNet would like to answer as follows:
According to Article 6 of Decree 76/2019/ND-CP, the subjects specified in Article 2 of Decree 76/2019/ND-CP will be entitled to a subsidy for the first time when they receive a job in an area with extremely disadvantageous socio-economic conditions, including:
Cadres, civil servants, public employees, employees in agencies, organizations, units of the Party, the State, socio-political organizations from the central to communes, wards, and towns, and wage earners in the armed forces (including in the case of dispatch, secondment, rotation, and without distinction between local and foreign arrivals):
Having been paid according to the salary table prescribed by competent agencies of the Party and the State, currently working and coming to work in areas with extremely disadvantageous socio-economic conditions, including:
- Cadres, civil servants, and public employees (including trainees) in agencies, organizations, non-business units of the Party, State, socio-political organizations from the central to commune level;
- Persons working under the labor contract regime in agencies and units of the Party, the State, socio-political organizations specified in Decree 68/2000/ND-CP and Decree 161/2018/ND-CP;
- Officers, professional soldiers, defense workers, public employees, and contract workers with salaries from the state budget of the Vietnam People's Army;
- Officers and non-commissioned officers receiving salaries; public security workers and contract workers receiving salaries from the state budget of the People's Public Security;
- People working in cipher organizations;
- People working in the payroll quotas in associations are supported by the state budget for operating expenses specified in Decree 45/2010/ND-CP and Decree 33/2012/ND-CP.
According to Article 6 of Decree 76/2019/ND-CP, the subjects specified in Section 1, upon receiving their first job at an agency, organization, or unit in an area with extremely disadvantageous socio-economic conditions, are entitled to a subsidy as follows:
- The first allowance is equal to 10 months' basic salary at the time of accepting work in areas with extremely disadvantageous socio-economic conditions.
- In the event that a family comes together to work in an area with extremely disadvantageous socio-economic conditions, in addition to the first-time allowance, they are also entitled to:
+ Fees for trains and luggage for family members traveling together are calculated according to the actual fare and fare of public transport or paid according to the contracted rate on the basis of the actual number of kilometers traveled multiplied by the unit price of ordinary public transport means (ships, boats, passenger cars);
+ 12 months' basic salary allowance for households.
- The subsidies specified in Clauses 1 and 2, Article 6 of Decree 76/2019/ND-CP, which are received by agencies, organizations, and units in regions with extremely disadvantageous socio-economic conditions, arrange payment work as soon as the beneficiary receives the job and only once in the total actual working time in areas with extremely disadvantageous socio-economic conditions.
The principles of applying the first-time allowance when receiving work in areas with extremely disadvantageous socio-economic conditions, according to Article 3 of Decree 76/2019/ND-CP, are as follows:
- Cadres, civil servants, public employees, employees, and wage earners in the armed forces who are subject to the policies specified in Decree 76/2019/ND-CP;
Those who are subject to the same policy as prescribed in other legal documents will only be entitled to the highest level of such policy.
- In case of retirement, service, demobilization, resignation, or job transfer out of areas with extremely disadvantageous socio-economic conditions (or the working place decided by the competent authority is no longer an area with extremely disadvantageous socio-economic conditions), then:
Stop enjoying the allowances and benefits specified in Decree 76/2019/ND-CP from the date of retirement, service, demobilization, or termination;
Or move out of the area with extremely disadvantageous socio-economic conditions (or the place where the work is decided by the competent authority is no longer an area with extremely disadvantageous socio-economic conditions), except for the case specified in Article 8 of Decree 76/2019/ND-CP.
