Regarding this issue, LawNet would like to answer as follows:

1. Position and functions of the National Digital Transformation Agency in Vietnam 

The National Digital Transformation Agency is an organization under the Ministry of Information and Communications; performing the function of advising and assisting the Minister in state management, organizing law enforcement on information technology application in state agencies, and developing e-Government and digital Government; is the focal point to synthesize, advise, coordinate, and promote national digital transformation.

The National Digital Transformation Department has legal status, its own seal and account according to the provisions of law, and its headquarter is located in Hanoi.

(Article 1 of Decision 1925/QD-BTTTT 2022)

2. Duties and powers of the National Digital Transformation Department in Vietnam

The National Digital Transformation Department has the following tasks and powers:

(1) National number conversion

- Advise and assist the Minister in carrying out the tasks of the Standing National Committee on digital transformation; Operate the Standing Task Force to assist the National Committee on digital transformation; Synthesize, advise, and coordinate inter-sectoral coordination activities between ministries, branches, and localities to implement policies, strategies, mechanisms, and policies to create a legal environment and promote national digital transformation;

- Preside and coordinate with relevant agencies and units to develop and submit to the Minister for promulgation or let the Minister submit to competent authorities for promulgation of legal documents on national digital transformation;

- Preside and coordinate with relevant agencies to develop and submit to the Minister for promulgation or for the Minister to submit to competent authorities for promulgation of long-term, medium-term, and annual development targets and plans on national digital transformation; which focus on developing digital government, digital economy, digital society, digital infrastructure, digital platforms, digital human resources, and network information security, meeting the goals of developing digital government, digital economy, and digital society on a national scale;

- Regarding promoting the development and use of national digital platforms: preside over and coordinate with agencies and research units, submit to competent authorities for promulgation and update the List of national digital platforms in stages; preside over and coordinate with relevant agencies and units to research and propose solutions to promote the use of digital platforms; monitor, measure, make statistics, and evaluate the use of digital platforms; Act as a focal point to coordinate with key agencies, units, and businesses to develop the national digital platform by building functional requirements and technical features;

- Regarding digital data: preside over the connection, integration, and sharing of data through the national data sharing and integration platform; organize coordination, inspection, supervision, and resolution of problems in the process of connecting and sharing data; Guidance on implementing digital data management activities, sharing management, and exploitation of digital data in state agencies, including open data; Supervise the implementation of digital data management activities, connection, sharing, and exploitation of digital data in state agencies according to the provisions of law; Collect, publish, and manage digital data in shared categories, categories of digital data providers, and digital data provided, published, and shared according to the provisions of law and as assigned by the Minister;

- Evaluate and rank the level of digital transformation of ministries, branches, localities, and the country;

- Take charge of building, managing, and operating the national digital data sharing and integration platform; National digital data portal; Government cloud computing platform; and other digital platforms serving the development of e-Government, digital government, and national digital transformation as assigned by the Minister.

(2) Applying information technology to state agencies, developing e-Government and digital government

- Preside and coordinate with units to develop and submit to the Minister for promulgation or let the Minister submit to competent agencies for promulgation of legal documents on: applying information technology in state agencies, developing e-Government, digital Government, managing investment in applying information technology, and digital transformation in state agencies according to the provisions of law;

- Preside and coordinate with relevant agencies to develop and submit to the Minister for promulgation or for the Minister to submit to competent authorities for promulgation of long-term, medium-term, and annual development strategies, plans, programs, schemes, and projects on: applying information technology in state agencies; developing e-Government and digital government;

- Guide, organize, and inspect the implementation of legal documents, policies, strategies, programs, plans, schemes, projects, mechanisms, and regulations on: applying information technology in state agencies, developing e-Government, digital Government, managing investment in applying information technology, and digital transformation in state agencies according to the provisions of law;

- Preside and coordinate with units of relevant ministries and branches to appraise, inspect, and evaluate the construction and implementation of programs, plans, schemes, and projects on: applying information technology; developing e-Government and digital government in ministries, branches, and localities according to the provisions of law;

- Preside over the development and submission to the Minister for promulgation or for competent authorities to promulgate and deploy, maintain, update, and organize the implementation of the e-Government Architecture Framework, Vietnam Digital Government;

- Preside and coordinate with relevant agencies to develop and submit to the Minister instructions on the structure, layout, and technical requirements for electronic information portals and public service portals of state agencies;

- Preside over the development of evaluation criteria and submit them to the Minister for promulgation and organize the evaluation of products and solutions applying information technology and digital transformation to serve the development of e-government and digital Government; effectively manage and monitor the level of provision and use of information by state agencies in the network environment;

- Preside over the construction, management, and operation of and guide state agencies to connect to the System for monitoring and measuring the level of provision and use of digital Government services.

(3) Information and communication technology in smart cities

- Develop, guide, and urge the application of the information and communications technology (ICT) reference framework for smart urban development in Vietnam;

- Propose the development and implementation of a project to build an ecosystem to apply ICT products and services in smart cities; pilot the deployment and use of smart urban products and services developed by domestic enterprises; coordinate with localities to organize the pilot implementation of smart urban development; Guide localities to deploy information technology applications to develop and provide smart urban products and services.

(4) Preside over the appraisal of project objectives, techniques, technology, scale, solutions, and results according to the provisions of law; as for the Ministry's investment policy in digital transformation and information technology application projects, it falls under the Minister's decision-making authority; Lead the appraisal of the project's basic design according to current legal regulations and appraisal and verification about goals, techniques, technology, scale, solutions, project results, and proposals for the feasibility study report for digital transformation investment projects, information technology applications, procurement tasks, outlines and detailed estimates for information technology application activities, and hiring information technology services using the Ministry's regular funding source, which fall under the decision authority of the Minister; Organize a performance evaluation, check, and determine the level of compliance with basic/preliminary designs and construction designs of information systems and digital platforms of the Ministry and agencies and units under the Ministry.

(5) Regarding propaganda and dissemination of laws, developing digital skills to serve the development of e-Government, digital Government and digital transformation in state agencies:

- Organize and deploy activities to provide information, propagate, disseminate, and replicate effective practices and models on information technology application, e-government development, digital government and digital transformation;

- Organize training activities to improve awareness, capacity, and digital skills on information technology application, development of e-Government, digital government, smart cities, digital transformation for officials, civil servants and public employees; coordinate to organize training activities for officials, civil servants, and public employees on e-Government, digital government, and digital transformation conducted mainly on massive open online learning platforms (MOOCs);

- Organize refresher courses and training courses on digital transformation and digital technology for leaders, managers, and staff working as digital transformation advisors in state agencies to commune levels, implemented mainly on mass-open online learning platforms.

(6) Participate in proposing, developing, and guiding the implementation of standards, regulations, technical indicators on quality, and economic and technical norms serving the development of e-Government, digital government, national digital transformation.

(7) Carry out scientific research activities to serve the application of information technology, develop e-Government, digital Government and national digital transformation; research and identify current legal barriers to new technologies and platforms.

(8) Organize statistics, collect and synthesize data, analyze and forecast information technology applications, e-Government development, digital government, and digital transformation; Prepare summary and statistical reports as required by competent authorities.

(9) Implement international cooperation in the field of information technology application, development of e-Government, digital government, and national digital transformation according to the Minister's decentralization and regulations and rules on international cooperation in the field of information and communications; Provide data to periodically evaluate and rank the level of development of e-Government and digital government in Vietnam.

(10) Manage finances, organizational structure, civil servants, public employees and employees, assets, records and documents of the National Digital Transformation Department according to the provisions of the law and the assignment of the Minister.

(11) To proactively develop public service activities in accordance with assigned functions and tasks according to the regulations of the State and the Ministry of Information and Communications; Preserve and develop assigned resources.

(12) Perform other tasks assigned by the Minister.
