Below, Thu Ky Luat would like to introduce prominent documents in the fields of labor, healthcare, insurance... that were updated over the past week (from October 17, 2023 to October 22, 2023).
This is the content presented by the Ministry of Labor, Invalids, and Social Affairs (Ministry of LDTBXH) to the Government of Vietnam regarding the Proposed Holiday Schedule for 2017 for officials and public employees and workers of administrative agencies, public service units, political organizations, and socio-political organizations. Accordingly:
- New Year: 03 consecutive days off from December 31, 2016, to January 02, 2017;- Lunar New Year: The Ministry proposed 02 options (PA):- PA 1: 07 days off without exchange; from January 26 to February 01, 2017 (i.e., from December 29 of the Year of the Monkey to the 5th day of the Lunar New Year of the Rooster);- PA 2: 10 consecutive days off from January 27 to February 05, 2017 (i.e., from December 30 of the Year of the Monkey to the 9th day of the Lunar New Year of the Rooster), with compensation work on Saturday, February 11, 2017;- Hung Kings' Commemoration Day: The Ministry proposed 02 options as follows:- PA 1: 01 day off on Lunar March 10 of the Year of the Rooster (April 06, 2017).- PA 2: 04 consecutive days off from April 06 to April 09, 2017 (with compensation work on Saturday, April 15, 2017).
Additionally, the Ministry also proposed holiday schedules for the occasion of April 30, May 01, and National Day September 02.
According to Official Dispatch 7537/BYT-KCB dated October 17, 2016, regarding the rectification of the situation of unauthorized transfer of patients for external treatment, the Ministry of Health requests Directors of Hospitals to:
- Seriously direct, review, and implement disciplinary measures to rectify the unauthorized referral and transfer of patients;- Strengthen the management of patients coming for examination and treatment at hospitals;- For hospitals with high overload conditions, patient monitoring and treatment at other medical examination and treatment facilities (satellite units) in the area should:- Conduct detailed professional evaluations, conditions of equipment, infrastructure, etc., ensuring sufficient capacity to receive patients;- Perform patient transfers in accordance with Circular 14/2014/TT-BYT on the transfer between medical examination and treatment facilities.
According to the guidance in Official Dispatch 4027/BHXH-ST dated October 14, 2016, the transfer of social insurance books (BHXH) to employees will be implemented as follows:
- Transfer books to employees only after the information on social insurance books and the database has been reviewed and updated, and cooperate with units to directly hand over to employees.- For social insurance books issued according to the form in Decision 1443-LDTBXH dated October 09, 1995, reissue the cover and all attached pages; print attached pages up to December 31 of the year prior to the review year;- For social insurance books issued according to the forms in Decision 3339/QD-BHXH dated May 16, 2008, Decision 1518/QD-BHXH dated December 20, 2011, and Decision 1035/QD-BHXH, do not reissue, only adjust and supplement information;- Transfer social insurance books to employees according to the Delivery Receipt List of Social Insurance Books (Form No. 01 attached to Official Dispatch 4027/BHXH-ST).
Social Insurance of Ho Chi Minh City issued Official Dispatch 2533/BHXH-QLT dated October 18, 2016, regarding the non-recovery of health insurance (BHYT) cards when employees resign. Accordingly:
- When there is a reduction in the number of health insurance participants, the unit must promptly create and submit a reduction list to the social insurance agency within the same month (by the last day of the month);- If the reduction is reported after the last day of the month, they must pay the value of the health insurance card for the following month and the health insurance card is valid until the end of that month; the social insurance agency will not recover cards in case of late reductions.
From October 17, 2016, the management of outsourced services at hospitals will be implemented following the guidance in Decision 6197/QD-BYT.
Service providers must ensure the capacity to deliver services:
- Have legal status;- Have sufficient capacity with equipment, facilities, and personnel to provide services;- Have financial capacity.
