Vietnam’s new regulations on environmental protection fee on wastewater

According to Decree No. 154/2016/NĐ-CP of Vietnam’s Government, the rate of environmental protection fee on wastewater is prescribed as follows:

- Regarding domestic wastewater: 10% of the VAT-excluded selling price of 1m3 of clean water (according to current regulation, the environmental protection charge rates shall be calculated in percentage (%) of the selling price of 1m3 (one cubic meter) of clean water but must not exceed 10% (ten percent) of VAT-excluded clean water selling price).

- The amount of environmental protection fee on industrial wastewater shall be calculated in the following manner: F = f + C, where:

+ F: Amount of fee payable;

+ f: Fixed fee (VND 1,500,000/year);

+ C: Variable fee, calculated on the basis of the total volume of effluent, content of pollutants and the fee rate applicable to each pollutant. In comparison with current regulations, C has been adjusted as follows:

  • Chemical oxygen demand (COD): 2,000 VND/kg (1,000 - 3,000 VND/kg according to current regulation);

  • Total suspended solids (TSS): 2,400 VND/kg (1,200 - 3,200 VND/kg according to current regulation);

Supplementing:

  • Mercury (Hg): 20,000,000 VND/kg;

  • Lead (Pb): 1,000,000 VND/kg;

  • Arsenic (As): 2,000,000 VND/kg;

  • Cadmium Cd: 2,000,000 VND/kg.

Decree No. 154/2016/NĐ-CP of Vietnam’s Government takes effect from January 01, 2017, replacing Decree No. 25/2013/NĐ-CP.
