Recently, the Government of Vietnam has issued Decree 32/2021/ND-CP , Decree 33/2021/ND-CP and Decree 34/2021/ND-CP on pilot urban administration model and certain special development policies and mechanism for Hanoi, Ho Chi Minh City, and Da Nang.
According to the Decrees, from July 1, 2021, the Presidents, Vice Presidents of the ward, and commune-level civil servants in the ward elected or recruited before July 1, 2021 will be transformed into civil servants working in the ward; in the case of transferring to a new job position, the civil servant must ensure conditions and standards suitable for that working position.
Specifically:
- For Hanoi: The Presidents of the People's Committee of the district or town shall issue a decision to change the commune-level civil servant working at the Ward People's Committee into a civil servant managed by the People's Committee of the district or town.
- For Ho Chi Minh City: The Presidents of the district and the President of the city under Ho Chi Minh City issue a decision to change the commune-level cadres and civil servants working at the People's Committee of the ward into civil servants on the payroll of the People's Committee of the district and city under the management of the People's Committee of Ho Chi Minh City.
- For Da Nang: The district Presidents issued a decision to convert a commune-level civil servant working at the ward UNBD into a civil servant on the payroll of the District People's Committee.
(Before the pilot, according to the provisions of Vietnam's Law on Cadres and Civil Servants, the Chairmans of the Ward People's Committee are officials)
Vietnam's Decrees 32/2021/ND-CP, 33/2021/ND-CP, and 34/2021/ND-CP take effect from March 29, 2021.
