Review of Judges if Verdicts Cause Negative Public Opinion

This is the form of disciplinary action against Judges specified in Decision 120/QD-TANDTC regarding the handling of responsibility for individuals holding judicial titles in the People's Court (TAND).

The Judge shall be subject to review by the agency or unit if:

- After being announced on the Court's electronic portal, the judgment or decision contains numerous errors discovered, causing negative public opinion and affecting the reputation of the People's Court of Vietnam (TAND);- Failing to issue the judgment, provide a summary extract, or deliver/send the judgment in accordance with the law;- Failing to promptly handle requests for civil case resolutions (more than 07 days) and lawsuits (more than 05 days) from the expiration date;- Issuing a decision to apply interim emergency measures not in accordance with the law or issuing a decision to temporarily suspend the trial or case resolution without the legal grounds as prescribed by law.

In addition, the Judge may be subject to other forms of accountability such as: temporary suspension of duties; reallocation of work; non-consideration for reappointment as a Judge.

Decision 120/QD-TANDTC takes effect from July 1, 2017.
