Responsibilities related to the discharge of industrial wastewater into receiving water sources in Vietnam

The Minister of Natural Resources and Environment of Vietnam promulgates Circular 06/2025/TT-BTNMT dated February 28, 2025, on National Technical Regulations on industrial wastewater, which stipulates the responsibilities of organizations and individuals related to the discharge of industrial wastewater into receiving water bodies.

According to the Circular 06/2025/TT-BTNMT on National Technical Regulation on industrial wastewater (QCVN 40:2025/BTNMT), the responsibilities related to the discharge of industrial wastewater into receiving water sources in Vietnam are as follows:

According to the regulation, the investment project owner and industrial wastewater discharge facilities are responsible for ensuring that pollutant parameters do not exceed the permissible limits specified in Table 1, Table 2 of this Regulation.

The investment project owner and facility are responsible for determining the pollutant parameters in industrial wastewater according to the principles specified in Section 4.1 of this Regulation based on the following grounds: Information on types of production, business, services; raw materials, materials, fuels, chemicals used; production technology, waste treatment technology, and the list of potential pollutant parameters (proposed in the Dossier requesting assessment of the environmental impact report, Dossier requesting issuance, adjustment, reissuance of environmental permits).

The competent authority for assessing the environmental impact report and issuing environmental permits will specifically determine pollutant parameters to be controlled based on proposals by the investment project owner and facility in the Dossier requesting assessment of the environmental impact report, Dossier requesting issuance, adjustment, reissuance of environmental permits. If other pollutant parameters exceeding the permissible limits specified in Table 2 of this Regulation are detected, additional control must be implemented according to regulations.

Circular 06/2025/TT-BTNMT takes effect from September 1, 2025.
