Procedures for granting a water transport permit across the Vietnam - Cambodia border

The Ministry of Transport of Vietnam issued Circular 13/2023/TT-BGTVT amending the Circular guiding the implementation of the Agreement on water transport between Vietnam and Cambodia, including amending the regulations on the order of granting a water transport license across the Vietnam - Cambodia border.

Procedures for granting a water transport permit across the Vietnam - Cambodia border

Regulations on the order of granting water transport permits across the Vietnam - Cambodia border in Article 8 of Circular 08/2012/TT-BGTVT are amended as follows:

- Organizations and individuals send directly, by post, or through the online public service system 01 (one) application file for a cross-border transport permit to one of the licensing authorities as prescribed.

- Authorities competent to issue permits receive and examine dossiers.

If the application is incomplete as prescribed, the licensing authority shall guide its completion within 01 (one) working day from the date of receipt of the application.

If the application is complete as prescribed, the competent authority shall issue the permit within 03 (three) working days from the date of receipt of the dossier and send it directly, via the postal system, or through the online public service system, to the organization or individual.

In the event of a refusal to grant a license, the licensing authority must reply in writing and clearly state the reason.

Authorities competent to grant transport permits across Vietnam - Cambodia border

Regulations on agencies competent to grant transport permits across the Vietnam - Cambodia border in Article 7 of Circular 08/2012/TT-BGTVT are revised to:

(1) The Vietnam Inland Waterway Administration is the competent authority to issue the Permits for cross-border transport for watercraft operating in Group 1 and Special Groups specified in Clause 1, Article 6 of Circular 08/2012/TT-BGTVT.

(2) The Department of Transport of the provinces and centrally-run cities is the competent authority to issue the Permit for cross-border transport for watercraft under the management of the locality and the Special Group specified in Clause 1, Article 6 of Circular 08/2012/TT-BGTVT.

(3) In case the Department of Inland Waterways of Vietnam issues a cross-border transport license to watercraft operating in transport, Group 1 and Special Group, as prescribed in Clause (1), are responsible for notifying the Department of Transport of the provinces and centrally-run cities where the vehicle is registered.

In case the Departments of Transport of provinces and centrally-run cities issue permits for cross-border transport of watercraft under local management, Groups 1, 2, and Special Groups, as prescribed in Clause (2) are responsible for notifying the Department of Inland Waterways of Vietnam.
