Learners under nominated admission may be accepted into public employee positions in Vietnam from December 7, 2023

On December 7, 2023, the Government of Vietnam promulgated Decree No. 85/2023/ND-CP on amendments to Decree No. 115/2020/ND-CP on recruitment, use, and management of public employees, which stipulates that learners under nominated admission are subjects that may be accepted into public employee positions.

Learners under nominated admission may be accepted into public employee positions in Vietnam from December 7, 2023 

According to the Decree, heads of competent recruitment authorities shall, based on the conditions for registering for public employee recruitment and requirements for the job vacancies, decide to accept cases meeting the standards and conditions for such job vacancies to public employee positions as follows: 

(1) Learners under nominated admission as prescribed by laws working at the province that nominated them after their graduation. 

(2) Persons with 5 years of engaging in professional operations in conformity with the job vacancies at agencies, organizations, and units established under laws. 

The working time prescribed in this Point is the time of engaging in professional operations in conformity with the job vacancies in compliance with laws with contributions to compulsory social insurance, excluding the probationary period according to Article 21 of Decree No. 115/2020/ND-CP.

In case the probationary period of the current job according to laws is less than the probationary period of the accepted job according to Clause 2 Article 21 of Decree No. 115/2020/ND-CP, the difference is counted towards the probationary period. 

In case of having inconsecutive working time without receiving lump-sum social insurance allowances, the time may be cumulated.

(3) Officials of communes engaging in jobs in conformity with the job vacancies. 

(4) Former officials and public employees transferred by competent authorities to work at other agencies, organizations, or units engaging in jobs in conformity with the job vacancies. 

(5) Persons with master’s degrees or higher (recognized by competent authorities under regulations) working at agencies or organizations with overseas headquarters or branches or foreign agencies or organizations with headquarters or branches in Vietnam having training majors in conformity with the job vacancies and at least 3 years of engaging in professional operations in conformity with the job vacancies. 

(6) Persons with special talents and aptitudes in conformity with the job positions concerning culture, art, sports, and traditional occupations according to the regulations of Ministries managing the mentioned fields.

Authorities competent to conduct the recruitment or assigned to conduct the recruitment may stipulate higher standards and conditions for acceptance cases mentioned above based on the characteristics of their agencies, organizations, or units.
