Guidelines on the Specific Procedures for Returning Criminal Case Files for Additional Investigation

Joint Circular 02/2017/TTLT-VKSNDTC-TANDTC-BCA-BQP has just been issued, stipulating the coordination between procedural authorities in implementing certain provisions of the Criminal Procedure Code regarding returning the case file for additional investigation.

Joint Circular 02 provides detailed and specific guidance on the cases where investigation dossiers of criminal cases can and cannot be returned, categorized into the following groups:

- Lack of evidence and proof regarding the issues stipulated in Article 85 2015 Criminal Procedure Code;- Serious violation of procedural regulations;- When there are grounds for prosecuting the accused for one or more other crimes; when there are accomplices or other offenders involved in the case but have not yet been prosecuted.

For detailed content, members are requested to follow Joint Circular 02/2017/TTLT-VKSNDTC-TANDTC-BCA-BQP which took effect on February 6, 2018.
