On May 17, 2024, the Minister of Culture, Sports and Tourism issued Circular 01/2024/TT-BVHTTDL regulating the anti-doping in sports in Vietnam.
Specifically, Article 16 of Circular 01/2024/TT-BVHTTDL guides the handling of complaints and appeals regarding anti-doping as follows:
- Within 21 days from the date of receiving the therapeutic use exemption conclusion, the violation handling conclusion, athletes, individuals, and related organizations have the right to lodge complaints and appeals against the therapeutic use exemption conclusion, violation handling conclusion. For WADA appeals, the right to appeal and the time limit for appeal are regulated in the World Anti-Doping Code.
- The Sports Administration Department decides to establish a Council for handling complaints and appeals regarding anti-doping to review and resolve complaints and appeals according to the provisions of the World Anti-Doping Code. The Council is established based on the principle of respecting the requirements outlined in the definition of independence regarding the organization and operation of the World Anti-Doping Code, the International Standard for Results Management, and in accordance with the provisions of the Law on Physical Training and Sports 2006.
- The Council for handling complaints and appeals operates based on democratic principles, voting by majority, and in accordance with the provisions of the World Anti-Doping Code and the International Standard for Results Management.
- The Council for handling complaints and appeals consists of 03 to 09 members, the number of members must be odd, including the Chairman and other members. Members of the Council are independent experts including legal, sports, and medical experts, and individuals qualified according to the provisions of the World Anti-Doping Code and the International Standard for Results Management.
- International athletes, athletes competing in international sports events, or in other cases as stipulated in the World Anti-Doping Code, have the right to lodge complaints and appeals directly to the Court of Arbitration for Sport (CAS).
- The operational duration of the Council for handling complaints and appeals regarding anti-doping is implemented according to the Council's Establishment Decision.
