On January 1, 2025, the Government of Vietnam issued Decree 01/2025/ND-CP amending Decree 107/2018/ND-CP regarding rice export business, which includes an addition concerning the case where a trader's Certificate of Eligibility for Rice Export Business is revoked.
The specific cases in which traders are considered by the Ministry of Industry and Trade of Vietnam to decide on the revocation of the Certificate of Eligibility for Rice Export Business as stipulated in Clause 1, Article 8 of Decree 107/2018/ND-CP (amended in Clause 2, Article 1 of Decree 01/2025/ND-CP) include:
- Traders who request the revocation of the Certificate of Eligibility;
- Traders who are dissolved or declared bankrupt in accordance with the law;
- Traders who have their Business Registration Certificate or Enterprise Registration Certificate, Investment Registration Certificate revoked;
- Traders who do not export rice for 18 consecutive months, unless they have notified a temporary suspension of business as per legal provisions;
- Traders who fail to maintain compliance with business conditions as stipulated in Clauses 1 and 2, Article 4 of Decree 107/2018/ND-CP during business operations;
- Traders who make false declarations regarding storage facilities, rice milling, processing establishments or commit other frauds to obtain the Certificate;
- Traders who fail to comply or correctly implement the instructions and regulations of competent authorities as stipulated in Article 15 of Decree 107/2018/ND-CP.
- Cases where after 45 days from the date the Ministry of Industry and Trade of Vietnam issues a written reminder to traders about rice export business, the Ministry does not receive reports from traders as stipulated in Clauses 1 and 2, Article 24 of Decree 107/2018/ND-CP.
Note: Decree 01/2025/ND-CP applies to traders under the provisions of the Commercial Law 2005; agencies, organizations with responsibilities in managing and directing rice exports, and other related organizations and individuals.
