04 Prohibited Acts in Audio and Video Recording Legal Entities Committing Crimes

Joint Circular 03/2018/TTLT-BCA-VKSNDTC-TANDTC-BQP has just been issued to provide guidance on the procedures for audio or video recording; the use, preservation, and storage of audio or video recordings during the investigation, prosecution, and trial process.

During the audio and video recording process for commercial legal entities committing crimes, the organizations and individuals conducting and participating in the proceedings must not perform the following acts:

- Arbitrarily edit, cut, splice, falsify, unlawfully destroy, distort, damage, or lose audio or video recording data;- Copy, disseminate, exploit, or use audio or video recording results for purposes other than those specified;- Disclose or leak case information or infringe upon the legal rights, interests, reputation, and honor of organizations or individuals;- Intentionally damage or misuse the technical means and equipment used for audio or video recording.

Joint Circular 03/2018/TTLT-BCA-VKSNDTC-TANDTC-BQP takes effect from March 18, 2018.
