Procedure for Issuing Construction Permits Online

From June 15, 2017, the issuance of construction permits for individual houses can be processed online with quick, streamlined procedures and cost savings. The People's Committee of Ho Chi Minh City provides guidance on the process of online construction permit issuance as per Decision 3090/QD-UBND as follows:

Document:

- Application for Construction Permit (According to the form in Appendix No. 1 of Circular 15/2016/TT-BXD);- File containing copies of one of the documents proving land use rights;- File containing copies of approved construction design drawings by the investor, including:- Site plan of the work on the land plot at a ratio of 1/50 - 1/500, along with the location diagram of the work;- Floor plans, elevations, and main sections of the work at a ratio of 1/50 - 1/200;- Foundation plan at a ratio of 1/50 - 1/200 and foundation section at a ratio of 1/50, along with connection diagrams for the rainwater drainage system, wastewater treatment, water supply, electricity, and information system at a ratio of 1/50 - 1/200.- File containing a copy of the appraisal report of the design results by the specialized construction authority for works required to undergo design appraisal according to regulations;- File containing a copy of the investor's safety commitment for the construction and adjacent constructions for constructions built close together with a basement;- File containing a copy of the organization's or individual's declaration of capacity and experience in design (According to the form in Appendix No. 3 of Circular 15/2016/TT-BXD), along with a copy of the construction practice certificate for works not appraised by the specialized construction authority;- For single-family houses under 3 floors and with a total construction floor area less than 250m^2^, families can independently organize the design and assume responsibility for the safety of the construction and adjacent constructions;- File containing a copy of the safety commitment for adjacent constructions in the case of building single-family houses with adjacent constructions.

The investor accesses the electronic portal of the People's Committee of the district, selects the level 3 online public service about the issuance of Construction Permit for single-family houses, and registers, logs in by creating an account. Simultaneously, upload the components of the application mentioned above to the single-window electronic department of the People's Committee of the district.

Order and procedures:

- The investor prepares the application components and submits them online to the single-window electronic department of the People's Committee of the district during weekdays.- The single-window electronic department checks and receives online applications from Monday to Friday (Morning from 07:30 to 11:30, afternoon from 13:00 to 17:00) and Saturday morning from 07:30 to 11:30).

Applications submitted on Saturday afternoon, Sunday, and public holidays, will be checked and processed on the next working day.

If the application is valid, the single-window electronic department issues an online receipt to the investor via electronic document and text message. No more than one day after issuing the online receipt, the single-window electronic department transfers the application to the specialized department (Urban Management Department) for processing according to regulations.

If the online application lacks components, the single-window electronic department immediately informs the investor (via electronic document and text message) to supplement and complete the online application.

- Within 7 working days from the date of receiving the online application from the single-window electronic department, the Urban Management Department assigns, conducts on-site inspections, and organizes the appraisal to resolve the application. During the appraisal of the application, the Urban Management Department must identify missing documents, documents not according to regulations, or inconsistent with reality and inform the investor via electronic document for supplementing and completing the online application.- If the online supplementary application does not meet the requirements: Within 5 working days, the Urban Management Department is responsible for informing the investor via electronic document for further completion of the application.- If the online supplementary application still does not meet the contents of the notice: Within 3 working days, the Urban Management Department advises the People's Committee of the district to inform the investor via electronic document about the reason for not issuing the permit.- When it is necessary to verify and clarify information to meet the conditions for issuing the Construction Permit, the Urban Management Department is responsible for collecting opinions from specialized departments of the People's Committee of the district, and the People's Committee is responsible for collecting opinions from relevant agencies and units about related fields of the construction according to legal regulations.

Within 12 days from the date of receiving the online document for opinion collection, the consulted agencies and units are responsible for responding via electronic document about the contents within their management functions. After this period, if these agencies and units do not respond online, it is considered that they agreed and are responsible for the contents within their management functions; the People's Committee of the district bases on current regulations to decide the issuance of Construction Permit online.

Upon reaching the permit issuance deadline, the People's Committee of the district must notify the investor via electronic document of the reasons and the extended time, not exceeding 10 days from the deadline.

- If the application meets the conditions for issuing the Construction Permit, the Urban Management Department prints out copies of two sets of construction design drawings along with the draft Construction Permit according to Appendix 4 (Form 7) in Circular 15/2016/TT-BXD to submit to the People's Committee of the district for signing, stamping, and transferring to the reception and result-delivery department for stamping and issuing within no more than 15 days.- The investor receives the results directly from the reception and result-delivery department of the People's Committee of the district or through postal service agreed upon, within the time recorded in the electronic receipt.

Fee:

According to Decision 3090/QD-UBND, the fee for issuing Construction Permit online for single-family houses is 50,000 VND/Permit.

Processing time:

Maximum of 15 days. Does not include the time for the investor to correct and complete the application.
