Hanoi-Vietnam: Increase in penalties imposed on divers consuming alcoholic beverages when operating vehicles

Currently, the Government of Vietnam is seeking public comments on the Draft Decree on amendments to certain articles of Decree 46/2016/ND-CP dated May 26, 2016, stipulating administrative penalties in the road and railway traffic sector.

Under this draft proposal, there will be an increase in the penalties imposed on divers consuming alcoholic beverages when operating vehicles. To be specific:

Penalties for drivers, persons carried in cars and vehicles similar to automobiles for violating road traffic rules

Operating a vehicle on a road where the blood or breath alcohol concentration exceeds 50 milligrams to 80 milligrams/100 milliliters of blood or exceeds 0.25 milligrams to 0.4 milligrams/1 liter of breath

- A fine of between VND 7 and 8 million shall be imposed

- Suspension from use of driving license for 10-12 months

- A fine of between VND 7 and 8 million shall be imposed

- Suspension from use of driving license for 01 - 03 months

- If causing a traffic accident, suspension from use of driving license for 2-4 months

Operating a vehicle on a road with a Blood Alcohol Concentration or breath exceeding 80 milligrams/100 milliliters of blood or exceeding 0.4 milligrams/1 liter of breath

- A fine of between 26 and 30 million VND shall be imposed

- Suspension from use of driving license for 10 - 12 months

- A fine of 16 - 18 million VND shall be imposed

- Suspension from use of driving license for 04 - 06 months

Failing to comply with the request of the official-duty person to check the alcohol concentration

- A fine of between 26 and 30 million VND shall be imposed

- Suspension from use of driving license for 10 - 12 months

- A fine of 16 - 18 million VND shall be imposed

- Suspension from use of driving license for 04 - 06 months

Penalties for drivers and occupants of motorcycles, mopeds (including electric motorcycles), vehicles similar to motorcycles and vehicles similar to mopeds that violate road traffic rules

Failing to comply with the requirements for testing of narcotics and alcohol concentration of official-duty performers

- A fine of between 5 and 7 million VND shall be imposed

- Suspension from use of driving license for 10 - 12 months

- A fine of between 3 and 4 million VND shall be imposed

- Suspension from use of driving license for 03 - 05 months

Operating a vehicle on a road with a Blood Alcohol Concentration or breath exceeding 80 milligrams/100 milliliters of blood or exceeding 0.4 milligrams/1 liter of breath

- A fine of between 5 and 7 million VND shall be imposed

- Suspension from use of driving license for 10 - 12 months

A fine of between 3 and 4 million VND shall be imposed

- Suspension from use of driving license for 03 - 05 months

Penalties for drivers of tractors and heavy-weight vehicles (hereinafter collectively referred to as vehicles) for violating road traffic rules

Operating a vehicle on a road with a Blood Alcohol Concentration or breath exceeding 80 milligrams/100 milliliters of blood or exceeding 0.4 milligrams/1 liter of breath

- A fine of between VND 7 and 8 million shall be imposed

- Suspension from use of driving license for 10 - 12 months

- A fine of 5-7 million VND shall be imposed

- Suspension from use of driving license for 02-04 months

Failing to comply with the requirements for testing of narcotics and alcohol concentration of official-duty performers

- A fine of between VND 7 and 8 million shall be imposed

- Suspension from use of driving license for 10 - 12 months

- A fine of 5-7 million VND shall be imposed

- Suspension from use of driving license for 02-04 months
