Fine up to 6 million VND for mortgaging, pawning, or receiving a pledge with CMND/CCCD Card

Draft Decree stipulating administrative penalties in the field of security, order, social safety; prevention and combat of social evils; fire prevention and fighting; prevention and combat of domestic violence to replace Decree 167/2013/ND-CP is still in the period of soliciting opinions for approval.

This draft regulation stipulates that any individual who mortgages, pledges, or accepts the pledge of an Identity Card or Citizen Identification Card will be fined from VND 4,000,000 to VND 6,000,000.

The fine ranging from VND 4,000,000 to VND 6,000,000 also applies to individuals who commit the following violations:

- Forging an Identity Card or Citizen Identification Card (The current maximum fine is VND 4,000,000);

- Using a forged Identity Card or Citizen Identification Card (The current maximum fine is VND 4,000,000);

- Buying, selling, leasing, renting, borrowing, or lending an Identity Card or Citizen Identification Card to commit acts against the law (The current maximum fine for renting, borrowing, or allowing another person to rent or borrow an ID card to commit acts against the law is VND 4,000,000)..

The current regulation under Decree 167 only stipulates a fine ranging from VND 4,000,000 to VND 6,000,000 for mortgaging an ID card to commit acts against the law.
