This is one of the notable contents in the Draft Decree regulating the sanction of administrative violations in the field of healthcare, replacing Decree 176/2013/ND-CP.

To be specific, Article 30 of this Decree specifically stipulates the fines for violations regarding the consumption of alcohol and beer and places where alcohol and beer are prohibited as follows:
1. A warning or a fine ranging from 300,000 VND to 500,000 VND shall be imposed for one of the following acts:
a) Consuming alcohol and beer at locations where the consumption of alcohol and beer is prohibited by law;
b) Persons from 16 years old but under 18 years old consuming alcohol and beer.
2. A fine ranging from 1,000,000 VND to 3,000,000 VND shall be imposed for one of the following acts:
a) Consuming alcohol and beer immediately before or during working, studying hours, and breaks during working, studying hours;
b) Inciting, provoking, enticing, or forcing others to consume alcohol and beer.
Thus, if this content in the Draft is approved, from the effective date of this Decree, any person who incites, provokes, entices, or forces others to consume alcohol and beer will be fined up to 3,000,000 VND. It can be seen that this regulation specifies the provisions in the Law on Prevention and Control of Harmful Effects of Alcohol and Beer 2019, which officially came into effect on January 1, 2020. Currently, the Law on Prevention and Control of Harmful Effects of Alcohol and Beer 2019 only stipulates that forcing others to consume alcohol and beer is one of the prohibited acts, but has not specified the penalty amount.
Additionally, the Draft Decree also stipulates that for the act of consuming alcohol and beer before operating a vehicle, a fine ranging from 3,000,000 VND to 5,000,000 VND will be imposed. In cases where the driver of a vehicle participating in traffic has alcohol content in their blood and breath, penalties shall be imposed according to the provisions of the law on traffic safety.
