Regarding this issue, LawNet would like to answer as follows:

1. What is the Department of Finance - Planning?

According to Clause 1, Article 3 of Circular 04/2022/TT-BTC, the Finance - Planning Department is a specialized agency of the district-level People's Committee, with the function of advising and assisting the district-level People's Committee in performing the function of state management in the field of finance - budget; and performing a number of tasks and exercising powers as authorized by the district-level People's Committee and in accordance with law.

The exercise of the function of advising and assisting the People's Committee of the district in performing the function of state management in the fields of planning, planning, and investment (under the responsibility of the Ministry of Planning and Investment) by the Department of Finance - Planning according to regulations guided by the Ministry of Planning and Investment.

In addition, the Finance - Planning Department has its own seal and account and must abide by the direction and management of the organization, employment positions, civil servant payrolls, civil servant rank structure, and work of the district-level People's Committees while complying with the direction, inspection, and professional guidance of the Department of Finance.

2. Duties and powers of Finance - Planning Department in Vietnam

Specifically, Article 4 of Circular 04/2022/TT-BTC stipulates the tasks and powers of the Finance - Planning Department in the field of finance - budget in Vietnam as follows:

- Submit to the People's Committee of the district, the President of the People's Committee of the district:

+ Submit to the People's Committee of the district: Draft decision on mid-term and annual development planning and plans; programs and measures to organize the performance of state administrative reform tasks in the assigned state management domains; a draft document specifying the functions, tasks, powers, and organizational structure of the Finance - Planning Division of the district-level People's Committee;

+ Submit to the Chairman of the district-level People's Committee draft documents on the financial-budgetary field under the promulgation competence of the President of the district-level People's Committee as assigned.

- Organize the implementation of legal documents, programs, plans, and other documents in the field of finance - budget after they have been approved by competent authorities; provide information, propaganda, dissemination, and education about the law; and monitor law enforcement in the field of finance - budget in the locality.

- Instruct agencies, estimating units of the district, and the People's Committee of the commune to develop annual budget estimates, summarize them, and submit them to the People's Committee of the district according to regulations.

- Act as the focal point for summarizing and making estimates of state budget revenues for revenues decentralized to management and budget expenditure estimates at district level; and summarize the commune-level budget estimates, district budget allocation plans and submit them to the district-level People's Committees;

Prepare adjusted budget estimates in case of necessity and submit them to the district-level People's Committees; organize the implementation of the budget estimate once it has been decided.

- Guide and inspect the management of finance, budget, prices, implementation of the accounting regime of the commune-level government, finance of cooperatives, collective economic finance, and agencies; administrative and non-business units of the state at the district level.

- Coordinate with relevant agencies in the management of state budget collection in the locality according to the provisions of law.

- Assume the prime responsibility for verifying the final settlement of investment capital for completed projects for projects using public investment capital within the budget managed by the district-level People's Committees (unless the Chairman of the district-level People's Committee otherwise prescribes) and projects using public investment capital from the budget of the commune-level People's Committee upon the written request of the chairperson of the commune-level People's Committee; appraise the settlement of commune budget revenues and expenditures;

Make settlement of district budget revenues and expenditures; synthesize and make a report on the finalization of state budget revenues in the district and the settlement of district budget revenues and expenditures (including settlement of district budget revenues and expenditures and settlement of commune budget revenues and expenditures); report to the district People's committee for submission to competent agencies for approval.

- Manage the public property at agencies, organizations, and units under the district management according to the provisions of the law on the management and use of public property and the decentralization of the provincial People's Council.

Appraise and give opinions on tasks considered and decided by competent agencies and persons at district level in accordance with the law on management and use of public property; organize the implementation of decisions on the formation, use, and disposal of public property assigned by competent agencies or persons at district level in accordance with the law on management and use of public property.

The owner of the custody account shall manage the money collected from handling and exploiting public property in accordance with the law.

- Manage authorized funding sources of superiors; manage financial services in accordance with the law.

- Manage prices according to regulations of the provincial People's Committee; inspect the observance of listing prices and selling at the listed prices of business organizations and individuals operating in the locality; organize the reception of price declarations according to the assignment and decentralization of the Provincial People's Committee and according to the provisions of law;

Assume the prime responsibility for conducting price appraisal for local state assets as decentralized by the People's Committee of the province; assume the prime responsibility for, and advise the district-level People's Committees of, the task of valuing assets in criminal proceedings and performing the state's task of price appraisal in accordance with law.

- Deploy the application of scientific and technological advances; build an information and archiving system to serve the assigned financial and professional management.

- Implement the regime of periodical and irregular reporting on finance, budget, investment, and market price with the district-level People's Committee and the Department of Finance according to regulations.

- Assume the prime responsibility for, and coordinate with relevant agencies and units in, inspecting the observance of the law on finance - budget; assist the district-level People's Committees to settle disputes, complaints, and denunciations in the financial-budget field in accordance with law.

- Manage assigned cadres, civil servants, finances, and assets in accordance with the law and as assigned by the district-level People's Committee.

- Allocate, pay, appraise, and finalize funding for units, organizations, and individuals in accordance with the law on the state budget.

- Perform other tasks related to state management in the financial sector as assigned, decentralized, or authorized by the district-level People's Committee and according to the provisions of law.
