The Law on Foreign Trade Management 2017 stipulates measures for managing foreign trade activities, developing foreign trade activities; resolving disputes regarding the application of foreign trade management measures. It also specifically abolishes certain provisions of the Commercial Law 2005.
From January 01, 2018, the following provisions of the Commercial Law 2005 are officially abolished:
- Clause 3 of Article 28 regarding the export and import of goods:
3. Based on the socio-economic conditions of each period and international treaties to which the Socialist Republic of Vietnam is a member, the Government of Vietnam shall specify the list of goods prohibited from export, prohibited from import, the list of goods exported, imported under the license of the competent state agency, and the procedure for issuing the license.
- Clause 3 of Article 29 regarding temporary import for re-export, temporary export for re-import of goods:
3. The Government of Vietnam shall detail the activities of temporary import for re-export, temporary export for re-import of goods.
- Clause 3 of Article 30 regarding transshipment of goods:
3. The Government of Vietnam shall detail the activities of transshipping goods.
- Article 31 regarding the application of emergency measures for international goods trading activities:
In necessary cases, to protect national security and other national interests in accordance with Vietnamese law and international treaties to which the Socialist Republic of Vietnam is a member, the Prime Minister of the Government of Vietnam shall decide to apply emergency measures to international goods trading activities.
- Article 33 regarding certificates of origin of goods and rules of origin of goods:
1. Exported and imported goods must have certificates of origin in the following cases: a) Goods eligible for tax incentives or other incentives; b) As stipulated by Vietnamese law or international treaties to which the Socialist Republic of Vietnam is a member.
- Article 242 regarding the right to transit goods;- Article 243 regarding transit routes;- Article 244 regarding transit by air;- Article 245 regarding supervision of transit goods;- Article 246 regarding transit time;- Article 247 regarding transit goods consumed in Vietnam
