Vietnam: Procedures for issuance of a Certificate of house ownership and land use rights

"Sổ hồng" refers to a Certificate of house ownership and land use rights according to previous regulations. Citizens applying for certificates in Vietnam shall follow the procedures for reissuing Certificates of house ownership and land use rights stipulated by the law.

The procedures for issuance of a Certificate of house ownership and land use rights are divided into the following 02 cases by the time of the application:

1. Certificate of house ownership and land use rights issued for both the house and the land

Required documents:

- Application form for issuance of Certificate of land use rights, house ownership, and other land-attached assets according to Form No. 04a/DK;

- One of the types of documents stipulated in Article 100 of the Land Law and Article 18 of Decree 43/2014/ND-CP for cases of land use rights registration;

- One of the documents stipulated in Articles 31, 32, 33, and 34 of Decree 43/2014/ND-CP for cases of registering ownership of land-attached assets;

- Proof of financial obligations; documents related to the exemption or reduction of financial obligations for land and land-attached assets (if any);

Place to submit applications:

- The People's Committee at the commune level; or

- The Land Registration Office at the district level.

Processing time limit: No more than 30 days from the date of receiving the valid application.

For mountainous, island, remote, or disadvantaged areas, the processing time limit is no more than 40 days.

2. Certificate of house ownership and land use rights issued only for housing after homestead land has been issued with a Certificate

Required documents:

- Application form for issuance of Certificate of land use rights, house ownership, and other land-attached assets according to Form No. 04a/DK;

- One of the documents stipulated in Articles 31, 32, 33, and 34 of Decree 43/2014/ND-CP;

- A diagram of the land-attached assets (except for cases where the document of ownership of land-attached assets already includes a suitable diagram);

- The issued Certificate in cases of additional certification of ownership of land-attached assets;

- Proof of financial obligations; documents related to the exemption or reduction of financial obligations for assets attached to land (if any);

- Written consent from the land user allowing construction of the work, notarized or certified.

Place to submit applications:

- The People's Committee at the commune level; or

- The Land Registration Office at the district level.

Processing time limit: No more than 30 days from the date of receiving the valid application.

Currently, the names "Certificate of house ownership and land use rights" and "Certificate of land use rights" as per previous regulations have been consolidated under the name Certificate of land use rights, house ownership, and other land-attached assets.

However, since the public has become accustomed to the term "Sổ Hồng", the procedures for the Certificate of Land Use Rights, house ownership, and other land-attached assets are often referred to as the procedures for issuing a "Sổ Hồng".
