The Law on Denunciations 2018 officially took effect on January 01, 2019, stipulating that competent agencies and organizations must handle the settlement of anonymous and pseudonymous denunciation petitions.
Based on Clause 1, Article 25 of the 2018 Law on Denunciations, the principle is that denunciation petitions that do not clearly state the full name, address of the denouncer, or after verification cannot identify the denouncer, or the denouncer uses someone else's name to denounce, or the denunciation petition is not in the correct form, will not be accepted for resolution.
Article 25. Receiving and handling information with denunciation content 1. Upon receiving information with denunciation content but the full name and address of the denouncer are not clear, or after inspection and verification, the denouncer cannot be identified, or the denouncer uses someone else’s name to denounce, or the information with the denunciation content is not reflected in the form prescribed in Article 22 of this Law, the authority, organization, individual with jurisdiction shall not handle it according to the provisions of this Law. |
However, in cases where the information with denunciation content as specified in Clause 1, Article 25 clearly identifies the person committing the legal violation, has specific documents and evidence regarding the legal violation, and has grounds for verification, the authority, organization, individual receiving will conduct the inspection according to their jurisdiction or transfer it to the competent authority, organization, individual to conduct the inspection for management purposes.

In cases where the information with denunciation content specified in Clause 1 of this Article clearly identifies the person committing the legal violation, has specific documents and evidence regarding the legal violation, and has grounds for verification, the authority, organization, individual receiving shall conduct the inspection according to their jurisdiction or transfer it to the competent authority, organization, individual to conduct the inspection for management purposes. |
Thus, competent authorities must accept and resolve anonymous or impersonating denunciation petitions if these petitions have sufficient evidence of legal violations and have grounds for verification.
