Which Authorities Have the Jurisdiction to Issue the CLV Cross-Border Transport Permit?

This is an important provision stipulated in Circular 63/2013/TT-BGTVT guiding the implementation of certain articles of the Memorandum of Understanding between the Government of Vietnam and the Kingdom of Cambodia, the Lao People's Democratic Republic, and the Socialist Republic of Vietnam on road transport.

According to the current legal regulations, the dossier for issuing the Transport Permit across the Cambodia-Laos-Vietnam border (hereinafter referred to as the CLV Intermodal Permit) granted to commercial vehicles is valid for one (1) year with multiple entries and for non-commercial vehicles is valid for sixty (60) days from the date of issuance as specifically stipulated in Circular 63/2013/TT-BGTVT.

The competent authority to issue the CLV Intermodal Permit is also stipulated in Circular 63 as follows:

- The Directorate for Roads of Vietnam issues the Permit for the following types of vehicles:

- Commercial vehicles including charter passenger transport vehicles, tourist passenger vehicles, and cargo transport vehicles;- Non-commercial vehicles including those owned by the agencies of the Communist Party, National Assembly, the Government of Vietnam, offices of Ministries, ministerial-level agencies, agencies under Ministries, vehicles of diplomatic missions, consular agencies, representative offices of international organizations in Vietnam with headquarters based in Hanoi.

- Local Departments of Transport issue Permits for fixed-route passenger transport vehicles, and non-commercial vehicles owned by organizations or individuals based in the locality, except for subjects specified in point b, clause 1, Article 10.

- Local Departments of Transport in border provinces adjacent to Laos and Cambodia as per Appendix I and Appendix II of Circular 63, besides issuing Permits as prescribed in clause 2, Article 10, are also authorized to issue Permits for non-commercial vehicles owned by organizations and individuals based in other provinces of Vietnam passing through the border gates of their locality.

Thus, the Directorate for Roads of Vietnam, local Departments of Transport, and local Departments of Transport in border provinces adjacent to Laos and Cambodia as per Appendix I and Appendix II of Circular 63 are the agencies authorized to issue the Transport Permit across the Cambodia-Laos-Vietnam border depending on the different types of vehicles as specifically regulated in Circular 63/2013/TT-BGTVT.
