What are the duties and powers of the Department of Education and Training in 2020?

According to Circular 12/2020/TT-BGDDT, the Department of Education and Training shall execute the duties and powers prescribed in Article 12 of Decree 127/2018/ND-CP, dated September 21, 2018, by the Government of Vietnam, which stipulates the responsibility for state management of education, Decree 46/2017/ND-CP, dated April 21, 2017, by the Government of Vietnam regulating the conditions for investment and operations in the field of education, and Decree 135/2018/ND-CP, dated October 4, 2018, by the Government of Vietnam amending and supplementing several articles of Decree 46/2017/ND-CP; Decree 86/2018/ND-CP dated June 6, 2018, by the Government of Vietnam regulating foreign cooperation and investment in the field of education, the relevant legal provisions, and the following duties and powers:

- Chair and cooperate with relevant agencies to submit to the Provincial People's Committee:- Issuing guidelines and organizing the implementation of legal documents on education; incorporating content regarding the network of educational and training institutions into the provincial planning as per the Planning Law and related regulations; local educational development plans; plans, programs, and projects for the development of high school education in the locality; plan for implementing the scheme to innovate the general education curriculum and textbooks assigned within the province's scope; education legal documents under authority;- The document of approval for the establishment, merger, division, separation, and dissolution of universities, branches of universities; pedagogical colleges, branches of pedagogical colleges in the locality;- Approval of the scheme for rearranging and reorganizing public educational institutions under the management scope suitable to local realities;- Approval of the plan for establishing, reorganizing, and dissolving specialized departments under the Department of Education and Training as regulated;

- Coordinate with the Department of Home Affairs to compile the annual staffing numbers of public educational institutions in the plan for the staffing quantity of the province's public service providers to submit to the competent authority for approval.

- Chair and cooperate with relevant units to organize recruitment or delegate the recruitment, utilization, training, and fostering of teachers, educational management staff, and staff in public educational institutions directly under the Department of Education and Training as per legal regulations.

- Chair and cooperate with relevant agencies to perform the state management function of the Provincial People's Committee regarding universities; pedagogical colleges, intermediate pedagogical schools, and provincial continuous education centers as decentralized by the Government of Vietnam.

- Provide professional and operational guidance to the Education and Training Divisions and those with educational monitoring responsibilities under the commune-level People's Committees.

- Manage teaching and educational activities in schools and extracurricular settings; direct the implementation of moral, lifestyle, and school safety education activities; organize and implement plans to deploy the scheme for innovating the curriculum and general education textbooks; execute and direct the communication activities regarding education in the locality.

- Participate in the actual assessment of the proposal to establish, allow the establishment of, higher education institutions, and branches of higher education institutions in the locality.

- Regularly update information regarding teachers and educational management staff under management into the education sector database. Fully and promptly execute policies for periodic annual and ad-hoc reports on statistics and disclosure of the local education field under management to the Provincial People's Committee and the Ministry of Education and Training as prescribed.
