Recently, the Government of Vietnam has issued Decree 80/2020/ND-CP regulating the management and use of grant aids that are not classified as official development assistance, provided by foreign agencies, organizations, and individuals to Vietnam.
What are the duties and powers of the beneficiaries of non-ODA grant aid in Vietnam? (Illustration image)
Decree 80/2020/ND-CP clearly states that the beneficiary of the assistance is the entity assigned the responsibility to manage and implement the aid approved by the competent authority. Article 14 of this Decree stipulates the duties and powers of the beneficiaries of grant aid not classified under Official Development Assistance (ODA) as follows:
- Organize the management apparatus and implement the program, project based on the decision of the managing agency;
- Efficiently manage and use the aid resources and counterpart funds of the program, project. In cases where the Project Management Unit is not established, the beneficiary must open an account to receive and disburse the aid at the State Treasury or a commercial bank established and operating under Vietnamese law;
- Implement revenue and expenditure activities for the aid through accounts based on the approved financial plan;
- Develop annual activity plans, financial plans for submission to the competent authority for approval;
- Develop annual state budget revenue and expenditure estimates for aids considered state budget revenues and submit them to the competent authority for approval;
- Conduct tendering according to current legal provisions on tendering
;- Monitor the implementation of contracts and handle arising issues within their authority;
- Conduct supervision and evaluation of the program, project;
- Take responsibility for accounting, finalization, and reporting on the full amount of received and used funds and assets;
- Report the aid reception status, the implementation progress, and aid disbursement every 06 months and annually to the managing agency. The final report on the aid must be submitted to the managing agency within a maximum of 06 months after the project ends;
- Be responsible for losses, waste, corruption, and violations within their authority during the organization, management, and implementation of the program, project, causing economic, social, environmental damage, affecting the overall goal and effectiveness of the program, project;
- Other duties and powers as prescribed by law.
In addition, the beneficiary of the aid must be identified in the approval decision of aid reception.
