Vietnam: Tasks that police officers must seek opinions on

Recently, the Ministry of Public Security of Vietnam issued Circular 04/2010/TT-BCA regulating the implementation of democracy in the work of building the People's Police force. This includes stipulating matters on which police officers and soldiers can provide opinions before the Head of the unit makes a decision.

According to Article 6 of Circular 04/2010/TT-BCA of the Ministry of Public Security of Vietnam, it is stipulated the specific matters that police officers must seek opinions on as follows:

- Matters in which officers and soldiers directly participate or through representatives for the Party Committee, unit leaders to discuss, unify, the head of the unit will decide or propose to the competent level:

+ Six-month and annual programs and work plans;

+ Administrative reform measures, improving working methods, combating negativity, corruption, waste, inconvenience, and harassment to the people;

+ Developing leadership and command personnel planning;

+ Training and development plans for officers;

+ Appointment, reappointment of leaders and commanders in the unit;

+ Regulations and procedures for work;

+ Organizing competitive movements;

+ Implementing personnel policies;

+ Evaluating the unit's work results;

+ Commending and disciplining officers and soldiers;

+ Recruitment, selection, logistical and financial work;

+ Evaluation and assessment of officers;

+ Personnel management measures, prevention of misconduct by officers and soldiers;

+ Leadership of organizational activities and mass movements within the unit.

- Process for seeking opinions:

+ The head of the unit notifies officers and soldiers of the projected contents for resolving issues stipulated in Clause 1 of this Article and requests direct opinions from unit leaders;

+ Organizing meetings to gather opinions or distributing opinion forms to officers and soldiers. Based on that, the head of the unit directs the functional department to study and absorb opinions of officers and soldiers and publicly announces the results of collecting opinions for officers and soldiers to know (except in cases with separate regulations);

+ In case the head of the unit has a decision different from the opinions of participating officers and soldiers, the head has the responsibility to notify and explain clearly for officers and soldiers to understand and uniformly implement.
